Not to defend others, but some research can be considered exempt from IRB approval and informed consent if it is considered "observational and non-invasive" like simply watching people in a shopping mall.

In cases like this obtaining informed consent is not necessary, BUT it was my understanding the these studies still have to considered by an IRB and declared exempt.
