Well, if you want to talk law, honey, I think you're doing it with the wrong person. Wrong people, actually, because Costello's a legal beagle, too.
You're right that it was true traditionally that whomever owned the soil owned it right up to the heavens and right down to hell, so ANYBODY entering your land or passing above/below it would be tresspassing:
Cuius est solum, eius est usque ad coelum et ad inferos.
But now that's not true. You only have a right to the stuff that is like, 'just above' your property. You know, trees and signs and stuff. You get enough height above your land to reasonably use it.
Other people are allowed to fly **** over your land. It's perfectly legal!
If you want to read about that in US law, I think the case is called
United States v Causby but I'm not sure.
