You have the right to your health care records, get them if you need them to prove your disability....
"Under HIPAA (Health Insurance Portability and Accountability Act), the Privacy Rule, gives you, with few exceptions (such as if we are deemed a threat to others), the right to inspect, review, and receive a copy of your medical records and billing records that are held by health plans and health care providers. A provider cannot deny you a copy of your records because you have not paid for the services you have received. Also, providers are not required to keep your records forever, and you must get copies in a timely manner to ensure you can maintain them."
"If you request an electronic copy of protected health information, a covered entity is required to provide you with such electronic copy to the extent it is readily producible. Covered entities are permitted to charge reasonable, cost-based fees that cover the cost of copying (including supplies and labor) to provide you with a copy of your protected health information. They cannot, however, charge you a fee for searching for or retrieving your records. They can charge you a fee to obtain them but you have the rights to them."
Many times it is a matter of completing and signing a form at the office, and paying a fee if required, to get a hold of them. I wish you well in obtaining your records and hope all goes well to get the support you need.
