I called the Traffic Division and the clerk said to just write a letter and a judge would take care of it.

But something way worse came up. When I dropped off the letter the clerk looked up my file to help me, and offered to print it out. When he did he pointed out that I had a battery against a police officer attached to the DUI!

I remember that the cop was pushing for that, but the judge ridiculed it in court and I really thought it had been dismissed. I guess he was wanting it to be dismissed but I put in a plea of no contest because so much was going on at the time that I just wanted it over with. I wasn't even in town and paid a lawyer to handle it.

I'm shocked. And now this looks really bad for several reasons. First I didn't put it down on their paperwork, just the DUI. So if it comes up I'll look like I was lying or evading. Second it will be really hard to believe that I didn't know that happened. Third even though 17 years ago, battery is a violent crime. It's very common for cops to allege battery because they can if you just touch them. But still why should someone believe that I didn't actually do anything violent, especially if they already have doubts because I didn't mention this?

I think I am screwed. The only thing in my favor, besides the fact that it was not a felony, is that it was long ago and was tied to a DUI and not a separate incident. Something like that could have come from resisting arrest or any other problem. I actually don't remember all the details. Like I said, really major things were going on at the time that actually made a DUI seem small and an annoyance more than anything.

The record shows that I was given no fine or jail time for that, only penalized for the DUI so that supports my sense that I thought the judge dismissed it. I don't think at the time I even understood that it was a charge. I don't remember though.

There is a slight chance that they either won't find about about it, or if they do, they may say it is too old to use against me. I may be asked about though. This totally sucks. I have the worst luck in the world.
