I know in this state (MA) they cannot do a criminal background check (CORI) unless you sign and allow them to. Well technically that is true. I asked my aunt, who knew someone, who new someone else to do one on me once.
I did run into a situation where an employee of mine was fired because they did a CORI, found stuff, and thought she had lied on her application. Luckily she came to me and I proved she did not lie and she got her job back. Apparently lying is more important than committing a crime sometimes.
and Yes, I believe these checks only go back so far. A few years back I was not able to work in my field because of my CORI. A few years later it showed nothing. You do not have to be convicted of the crime for it to show up either.
Depending on the job you seek, these are usually just criminal background checks.
There are also suppose to be guidelines or rules in place when people call for references. I know where I worked, they were only allowed to say "Yes she worked here from then until then" I don't know if these guidelines were just for where I worked or if it was a law type thing.
You can always call and ask why you were not hired. I don't see any reason why they would not tell you. If you don't now you can't fix it.
