Mine was worded into the divorce. I have a pre-existing health condition that has an unknown future. At that point in time it made sense to have him continue to carry me on his employer health plan as a just in case. No arguments from attorneys or the judge. I live in MA.

Edit to Add: It was also worded with a provision about maintaining employment. Still liable if willfully loses employment type of provision.
