Another observation.
In a civil case, if you do more damage than you intend, you're still liable for
all the damage. (If I read this correctly.)
In a criminal case, your intentions count. Eg, if you punch Eggshell Skull in the head and he dies
only because his skull is unusually thin, you would probably not be charged with first degree murder.
