this is what google has to say "First degree murder requires that a defendant plan and intentionally carry out the killing, whereas second degree murder requires that the killing either be intentional or reckless, and occur in the spur of the moment."
But an intentional act in 1st degree can be driven by an emotion such as fear or anger, so 1st degree is not the same thing as 'instrumental aggression', it is just planned and intentional. Cold blooded psychopaths get convicted of 2nd degree murder too.
