I didn't say it was the same thing. It's one of the things that's considered by the Court when determining whether a murder is 1st or 2nd degree. And yeah, it isn't always clear, nor is it the only consideration.

And again, I was talking about my own behavior and what might cause it. I only gave the Court example because you asked about it.
