My supervisor has been saying I can't perform my job functions and that my performance isn't adequate. Which is the first I've heard of this and it happens to be after I told them I was having problems. I called our version of HR and apparently I have a legal case and that they can't use it against me. I'm still where I can't function after having a great day knowing I may lose my job. I may have all the legal standing in the world but that doesn't mean I still won't get fired. Then we will have no income. Everyone I've spoken to about this says I have a strong case with all the proof of text messages. But I just can't get past it. The text saying I can't do my job. Trying to play it as she is worried about me.

If the HR Dept. of the same company is telling you that I would not think you should not have to worry. And I would think if the HR Dept. is worried about legal action they would have a little talk with your supervisor. It seems pretty obvious to me that if you have been suffering from depression it would effect your work. But if you have been honest about it that is all you can do. I don't know if I would have had a legal case or not. I got fired from my last job for missing to much work due to depression. I had doctors notes. Was on state disability for awhile. I called my field foreman every morning and emailed the main boss all the time on my status. They still fired me. Maybe I could have done something about it. I didn't realize the FMLA was a year so that wouldn't have worked. I was so depressed I couldn't return to work anyway since then. If you can get FMLA soon I would do it. I know this probably doesn't make you feel better but that is my experience. Things will work out one way or another. I dunno if this site will help any. We do have rights. I no longer have to worry about my job. Apparently our version of hr explained to my management and supervisor that it was all illegal. Etc.
Makes me feel better that my job is no longer on the line Now to last until December when my fiancé and I are financially able to move. My meds are doing really well. I have energy and am able to function. My aunt sort of called me today and said in the most southern accent "don't you worry about your job sweetheart you go out and buy you something pretty" it's the small things. I am happy your meds are working and that things worked out with your job. Good thing you contacted the hr department. I hate it when people try to bully folks like that. Good luck.
