I got a letter through yesterday saying that I am not entitled to receive ESA from the 24th July because I have been found capable of work following a work capability assessment. I got 0 points and you need at least 15 points to get ESA. Before I got the decision through a woman at the job centre said that I could appeal it but is there any point in me doing this if I got 0 points? Surely they aren't going to change their mind. I don't understand how I got 0 points anyway because I couldn't do the memory test. Also the people who know me better: my GP, psychologist, and OT, all say that I am not fit to work and I personally don't feel that I could hold down a job. I'm scared that I'll have to go on jobseekers allowance and be forced into a job that I can't do and i'll get more ill.

Hello lindsay,
This must be frightening for you. If all of your doctors state that you are incapable then whoever did the assessment has made a simple decision that is wrong. Make the appeal and have your doctors reports made available through Freedom of information and get a copy of their decision under the same FOI act. Yes, I would appeal. There have been a lot of problems with ESA and many people found capable for work have appealed and got the decision reversed. Going from 0 to more than 15 points is not uncommon. You should get help from CAB or similar organisation. The "Benefits and Work" website might also help you understand the appeal process - benefitsandwork dot co dot uk - I am not able to post links until I have posted ten times.

I think Echoes has a point there; but maybe you can find something whilst you are on disability if you are put on that?
I'm currently doing a Ph.D. in order to get myself off disability and earn some money to improve my lifestyle and to fund my most treasured dream, a pilgramage to my Grandmothers grave...I know anything is possible and I hope you do to, Rhiannon
