I am having a hearing on sept. 7th to determine if i can keep my SSI benifits. Months ago SS determined that because i was able to work 18hrs a week I no longer had the right to keep my benifits. Untill the hearing I am able to keep my $700 monthly cheack but if they come to the descion at my hearing that my condition has improved or any other BS reason my parents and I will have to pay them back all the money I recieved from them for the past 8 months. I dont have a job now, i quit in march it was too much for me, i couldnt do it anymore. Im trying to find a lawyer to represent me at my hearing, Im so fu***** scared. i'm already broke with my monthy cheack from SSI, i dont know whats gonna happen if they take it away and my parents and I have to pay back allll that money. I am grateful though for my parents who are so so supportive, Im 26 and they still help me out with so much, i wish i could work so they didnt have to. I'm really scared for me but mostly for my parents. Does anyone have any advice for me????

Advice.... don't scare yourself. I don't know much about SS rules but there are people here who do know SS very well. It doesn't sound like you're in trouble.
I would think the worst that could happen is that the part time work paid well enough to affect your benefits then the difference will be deducted from your future checks until whatever the difference is paid. Try to relax and stay calm Don't hire a lawyer until someone here with a good understanding of SSI and earned income replies to your post. Take care |

I would get good, current letters from your doctors if you can, to show you are still disabled. Having worked and then quit (rather than being laid off or fired by your employer because you could not do the job) does not look good. They review everyone every one to six years and if you did/did not tell them about your change in income, that could have triggered the review.

I did tell them about me quiting my job, i am getting a letter from my doctor and i am getting old medical files from my old doctor, the reason why i am having this review is because i told them how i got a job (last year) so they discided that since i was working at that time that i didnt need any my benifits anymore even tho i was only working 18hrs a week. i personaly think the government doesnt have the money anymore to give everyone their benifits so there cutting poeple off. i kno some poeple dont deserve ssi benifits, but i honestly do. I have bipolar, it affects how much and how long i can work. sometimes i cant work at all. i feel cheated by ss for questioning my case. im so overwhelmed. i try not to get worked up about it but i cant help it. thanks for your advice guys.

I think you'll be fine. I was thinking that you could work a little even if you received SSI or SSD. I don't see how your decision to leave the job makes much difference. You tried and you realized you couldn't do it. If you had been fired because you couldn't function well enough, the end result would have been the same. If I was in your position I wouldn't hire a lawyer until and unless the benefits are denied.

It does not matter how many hours you work, if you "can" work, the SSI is affected. The definition of handicapped they use pretty much says you are so handicapped, you cannot work to make money:
