I have some questions in regards to my ssdi benefits. I am hoping that I can finally get into a chat room and ask someone who had to go threw what I am in obtaining my ssdi . For example to one of my questions:
if you had a substance abuse problem to two of the meds I was on for my conditions and have been clean from them for 8 mths now and have explained in hearing that my physical and mental conditions are not a result of me abusing those 2 meds and I have been suffering a long time before I became dependant. Will I still get awarded my benefits? Keep in mind, I have a lawyer handeling this for me. Anyone has answers for this, please help!!! Thanks |

I'm wondering what your lawyer thinks. Is this lawyer one where if you don't get SSDI, then he doesn't get paid?
I didn't have an official hearing, but I had to go for medical and psychological testing. I did receive my disability. |

You have the right idea about what the argument has to be. Like Payne, I'm wondering if your attorney has given you an idea of what to expect.
I got SSDI a year ago. Mine went pretty smooth, but I read up on all the pitfalls, just in case. My reading told me that an attorney won't even take your case, unless he/she believes that you will ultimately win. So stay hopeful. Also, by federal law, no attorney charges for representing someone on getting SSDI, unless the claim is successful, as you probably know. Since you have a lawyer who believes in your claim, you probably will eventually get SSDI; it's a question of when. Unfortunately, the longer it takes, the bigger a chunk of the initial payment that will go to the attorney. Mainly, you want to emphasize that you did have a very serious and disabling condition before you got into misusing the meds. As your lawyer has told you, I'm sure, you need evidence for that. Evidence would be, like, a series of job losses related to your disability. Good luck, and keep us posted. |

If you are concerned about how to answer what you asked in your post or questions pertaining to it, talk to your attorney about your concerns and see what he/she thinks as to how best to be answer the question honestly.
