I agree and disagree... with everything said My atty doesn't appear to have done much but she knows the system. Also knows the judge but that's another story.
I think the law office working on my case was less than competent. They missed deadlines and failed to communicate with me regarding medical records that they failed to obtain... or failed to update.
There doesn't appear to be much rhyme or reason to SSDI claim decisions. The judge who conducted my hearing was a little perplexed about why my claim had been denied in the first place and why SSA failed to provide him with a reason.

From what I know nearly everyone is denied the first time--- it's part of their system to keep their work load down.

And yes, very few that I know of win appeals without a lawyer.

Good wishes! The good part is once you are approved all the benefits are retro to the date of the FIRST application.

Thanks, I am hoping I get the 2nd time, if I not I hope I get enough back pay to cover the lawyer expenses, we don't have any money. I applied the last week of January I think, we are still in the information gathering process for reconsideration stage.

On your application you stated that you are disabled because of hearing impairment, a speech impairment, basement membrane disease, tinnitus, and chronic shoulder pain. You are able to think, act in your own interest, communicate, handle your own affairs, and adjust to ordinary emotional stresses without significant difficulties. We realized that your conditions keep you from doing some work but it does not keep you from doing less demanding work. Based on age, education, and past work experience. First of all I thought I did horrible on the examination, not because I wanted to but I did some stupid things, I couldn't answer some of the questions properly. I Had to have my relative take me to the examinations. During the hearing test it made my hears hurt, I ended up sleeping the rest of the day. Secondly, I do not have any past work experience or training. And I'm barely starting out in college, mostly online courses.

Now for my question how do I appeal this?
I immediately got an attorney who is now in the process of preparing me for a hearing. everyone is denied the first time and usually for the reconsideration. I got the same reasons you got for denial
