I don't know if they have to. Mine was willing to do it because he thought it was best for me.

If you don't want them to they don't have to (don't give a release) but in the SSDI process I would think that would only hurt you.

However, if you are saying you NEED the records and they are not willing to release them?
Than you ask for a copy of all your records (you are entitled to them), you may have to pay a small fee and then you can bring them to the SSA office or fax them, or mail them. |

They don't necessarily have to SAY you can't work..but over time depending on what is in your records....your records could help and be valuable in SSDI making a decision..as long as your Dr. hasn't written anything to suggest that they think you should go back to work.
I never specifically asked my pdoc or tdoc for SSDI records, I just told them I was applying for SSDI...and I asked for a copy of my records to send to my lawyer...I was given them...I read them...and the place I went to for treatment did put a lot of detail in the records of my "complaints" for each visit and there was nothing that ever said from the Dr..I think she can't work....but the content of the records supported my claim and I was approved for "mental" and I really thought I was going to be approved for "physical" Neurological stuff that is going on. |

This was the first time I applied I signed for SSDI to obtain all my records but I didn't know they don't have to release them too them. They have to release them to me. It's because of what happened while I was there. I have been in contact with person who is looking at the case. I sent him the same records I have for my divorce. The psychologist signed my MAS. I'm at a different place now and they have been in contact with him so I will finally get tested something the other place wouldn't do. I never would have thought they could do that.

MAS is a state of WI medical exemption to work for able bodied people who have no dependents and no income. You receive food and badger care WI already had this for 15 yrs Health Ins based on your income. I need a Nuero- Psych test because what happened was the mad Psychiatrist decided to reduce the Paroxetine dosage from 40mg-20mg and 3 weeks later I awoke to what sounded like someone tossed a pack of firecrackers in my head and I'm not the same person I used to be. My T interrogated me about this. I had to keep a journal of my symptoms. They put me back at 40mg but all the meds I took worked well now just side affects. So when the extobe went bye bye. She wrote a letter to the court explaining that the reduction definitely has affected me mentally and physically and was unemployable but I hoped to be able to work again. I was receiving UN-employment but when you can't work your not eligible she was terminated 3 weeks later I feel terrible the last thing she told me was to keep fighting I didn't realize she was already terminated. They kept throwing pills at me but It was hopeless My CNS is shorted out, not fun when you realize you can't do alot of things like you used to do.

Wow..Paxil....I heard all about it...not good.
So, now if you can't work..than UN-employment goes away? That really s*cks. I feel bad you are going thru so much. Is there anything you can do for rehabilitation? Unfortunitly the place I was at done absolutly nothing or medical doctors they done a brain MRI to look for a tumor and a nuerologist did a flashing light test for seizures all negitive I do have chorea almost every day now. The abuse and divorce was never a topic only my symptoms and then they tossed pills my way just what I need. They never helped. Then in june I went deaf fluid behind both ears effusion they call it things got worse he just poked them in the tubes clogged up in less than a week I went to other ents they said go back to the doctor who done this and my attorney withdraws i still haven't had a ent suck that goo out its like glue I gotta go I'm starting to get anxois

no you do not have to sign the release of information forms allowing your doctors to give SSI\SSDI information from your records that said if you dont allow SSI/SSDI to contact your doctors then the only thing they can do is either deny your application or consider you to not be disabled or send you to their own specialists on the Social security approved treatment providers list for evaluation.
they cant decide with no information whether you are disabled or not. what happens in that case you get a denial letter saying due to lack of information and determination of your disabilities they have to deny giving you SSI/SSDI grants. that when your situation changes you can reapply or ask for a hearing. at the hearing they will ask you if you will give them permission to contact your doctors and if you are willing to see the specialists that SSI wants you to see. if you refuse they again deny your application. the best thing to do is give SSI\SSDI as much information as possible that way they will have all that they need to decide whether according to social security standards you qualify for receiving SSI. my suggestion is sign the release forms and give your doctor the forms that SSI needs filled in, then if SSI needs more information they will send you a letter telling you what specialists Social security wants you to see. you contact those specialists (psychiatrists, medical doctors and others) schedule the appointments and go to them. they report to SSI what they have found are your disabilities. |

I don't think you understand I signed a release for all medical records to go to the ssdi case worker the first step goes to your state ssdi and any appointment information goes right to ssdi it is your health clinic, hospital and mental health clinic that don't have to give your medical records to them it will say report next to the healthcare facility that won't release won't release them. My case went to review and is on hold to take a test monday at my new mental healthcare clinic.

Your provider won't release the information? that's awful! Both as a healthcare provider and a human I can't believe someone would be so uncaring. I'm sorry you have to go through this.

How nerve racking...a good thing for me in this situation is I always freeze at tests. However, if your going to freeze at test..this is the time to do it! Best of luck. Hi it was Monday and the test was a lot of number and word sequencing. Like 8,6,4_
what a terrible truth to know how bad this made my ability to concentrate u got ten min i was only half done at 10 min the rest was true false about your ways of thinking and alcohol and drug use. I could notice after the bad withdrawal something was different. It's like parts of who I was are missing and just getting ready to go somewhere I need a lot more time now.It wouldn't surprise me if they revoked my drivers liscense. |

I was turned down for my Disability in Jan. My mom handles my finances and stuff because I don't understand it and don't know how to write a check, I have tried several times over the years. When I went to school in the very small town with a population just over 200 we weren't taught that back then. I didn't get a chance to look at the papers they sent me to file my appeal and with my daddy cleaning a pistol in Oct and shooting himself in the leg and having to have a Titanium rod in his Femur bone he has been back and forth for Therapy every other day. To make a long story short my time ran out for the appeal so I have to start back over and file for Disability again.
I have been over stressed since they cut my check last June along with my Medicaid and Medicare. My Dr started cutting my Ativan lower from 90 a month to 40 a month. This time I am doing it with a lawyer we know that used to be our DA. I pray that everything goes good for you Save

For a doctor to refuse to comply with reasonable requests from a responsible party, like the SSA, for records for a legitimate purpose, that the patient has signed a release for, is a form of professional misconduct. Doctors have a duty to be helpful to you in this matter.
