I need someone with information on how the baker act works to give me some insight. Recently I have a mental breakdown and hear some voices. I told the police and they baker acted me. The hospital classified me as scizophrenic and want me to take medication and I refused. They came into my room after 4 days and gave me a shot of haldol and that point I realized if I wanted out I had to take meds so I did I got out ten days later. My question is I have to see a phyciatrist for medication if I don't want to go and don't want the medication can he baker act me. I feel like it should be my choice to take the medication if I want right, or wrong. I feel like my breakdown was misdiagnosed now they are trying to tell me I NEED the medication or ill be super paranoid well. i got some advice from one person already and he told me i need to get a different psychiatrist to re- evaluate me and i need a medical document that says i dont have scizophrenia, and if i have that i cant be baker acted for refusing to take the medication. First of all the meds make me throw up, gain alot of wait and make me sleep a long time. i dont like them i dont want to take them. i am not a harm to myself or others. so whats the end result if i went to the doctor and was like i dont need the meds i feel fine could i be baker acted. i need answers and ways around this please help i am completly fine and was misdiagnosed now i am always being threaten to be baker acted like wtf!! should i go get an evaluation from a different psychiatrist and get a document saying i dont have schizophrenia before i tell i dont want meds. what do i do please help! thanks

Having a piece of paper that says you aren't schizophrenic will not prevent you from getting Baker Acted again. You have the right to not take meds, but don't tell the cops that you are hearing things again. If there is a court order that you need to see the pdoc and take meds and they are involuntarily taking your blood levels you'll have to do that. But if they made an appt for aftercare for you and it is not court ordered you don't have to go.
You could go if you feel fine now, and see what the doc thinks. The kind of meds you take can be negotiable. If you were hearing things, that is pretty serious so you may want to try to find out why that happened for your own sake, and your future.

definitly not court order to go to the psychiatrust so that mean that they cant drug test me either. so i have the right to refuse the meds and they cant be like hes incapable of making decisions on his own so baker act him? definitly not hearing voices or having delusions i was misdiagnosed when i told the cops that i was just looking for attention. so i cant be baker acted for refusing to follow his orders and take the medication or for that matter show up to his office for evaluation? thanks for the help

They can't drug test you? Are you taking illegal drugs. That certainly can cause psychotic breaks. Not familiar with the Baker Act...but from what I gathered here, it is forced mental health law...under court rulings. Also, since you don't mention your age on your profile, from my long-time ago education, schizophrenia appears rather early in life as in late teens to early and mid 20s.

However, there may be a blur here as you seemed to be concerned about drug testing, and if you are using can be a misdiagnosis for schizophrenia.

here in NY being hospitalized against your will (in your words Baker act) can happen if you are a danger to your self or others.

we also have a system where if anyone - treatment providers, family, friends believe you are not about to make your own mental or medical decisions due to mental or physical defect can have you involuntarily (against your will) committed to a mental health facility.

examples of when this is done here in NY -

when someone is suicidal
when someone is homicidal
when someone is self injuring
when someone knows they need medication but the type of mental disorder you have may be telling you, you dont need meds or the meds are harming you if you take them,
when someone has an eating disorder refuses to eat, their weight gets down to where it is putting their self in danger...

here in New York State everyone is able to get a second opinion any time they want to, about anything even with mental health issues.
