I would also highly recommend sending the letter registered mail. My own personal experience with this type of landlord was that she attempted to keep our security deposit to fix things that were her responsibility. I would mention in the letter the improvements that you’ve made to the property without compensation and repairs that you’ve been waiting for him to make. Something along the lines: Dear Sir, Due to your recent request for an increase in the rent, increase due to my therapy dog, and incomplete repairs I find it necessary to terminate our rental agreement. As you know I have requested (list repairs needed and dates when he was notified) and these things have not been repaired in a timely manner. We have made every effort to make this relationship work including making repairs at our own expense (list improvements with costs and dates). Please consider this my written notice. I will be vacating (property address) on (date). I would like to schedule a walk through at your earliest convenience so that my security deposit of (amount) will be released at the earliest possible date. Please record my new address of x, for your records so that there are no communication problems in the future. Thank you,

You rarely get the whole deposit back, they find things like nail holes and such to deduct for. See if the law allows you to receive it even if there's NORMAL wear and tear. If he still doesn't return all of it, you can tell him you will be filing a complaint with the BBB (future renters will check there?) if not.
Have YOU checked the BBB of the place to where you're moving, btw? ![]()

Enjoy the new place, Dear Person.
The good thing about moving is that it gives you an opportunity to get rid of things that you no longer need, so you can lighten up your load. The charities could use household items you may have duplicates of ... and clothes, towels, curtains - anything, can go to the goodwill. And with a dump run for unuseables, you are ready to go across the street. Thank goodness you haven't far to go. Best to you and yours. peace, night ![]()

ty _Sky we have been with this Landlord for 6 years we lived in another building of his and he forwarded the deposit to the house , will we still be able to get some of it back ?

Angie, if you are leaving this last place in good repair, and all of the deposit was transferred when you moved there (and he can't suddenly say it wasn't) then you need to ask for all of it back. It's illegal for him to keep the deposit if the place is in good shape.

In an effort to prevent landlords from taking advantages of tenants, some states even have laws that grant you triple your deposit if he refuses to return it. In Michigan for example (where I had my run in with a slum lord) the deposit is supposed to be in a seperate account in both our names. During your final walk through, the landlord is supposed to have the initial walkthrough for you both to review.
My landlord did not do an initial walk through period, let alone one that was signed by both of us. This prevented her from claiming any damages except for the final water bill that came in her name that was in the lease that we were responsible for. There was an aluminum storm door damaged by the city while plowing the alley next to the house. (Which she claimed was worth $300) I notified her immediately when it happened. She instructed me to notify the city, which I did, but the city stated that the owner of the property had to submit the claim; which I relayed back to her. She did nothing, but tried to charge me for the door. I was trying frantically to prove that I called the city when my friend from the housing office told me that I didn't have to worry about it, she did not have an initial walk through and she kicked me out of the final walk through. Either one alone prevented her from claiming damages. Contact the housing office in your city or county, they should have a pamphlet printed about your rights and obligations as a tenant and his rights and responsibilities as a land lord. I was lucky that I had a friend in the housing office and that she was being investigated already by the city for slum lord practices. She called and instructed me not to allow the city inspector into the house I was in. I don't know how long you've lived at this address, but the longer you occupied the dwelling the more "normal wear and tear" you are allowed.
