I've had an ongoing issue with one of my neighbors and their livestock coming on my property because the don't maintain the fence between us. I know fences should be maintained by both neighbors, but it is there damned animals who tear down the fence and walk through.

This morning my "boys" (horses) did not come up for breakfast when I called them. Could not see them in the pasture. Walked the woods at the back of my property. Was about to head back to the barn when I spotted them in the woods next door! WTF!?!? They never mess with the fence. How the H E L L did they get next door???

Then I discovered the neighbor's took down a long stretch of wire. The boys just walked through the resulting gap. They did this once before and one of the horses got seriously hurt. Thankfully both are fine today. I thought I made it clear to the neighbors last time this happened it better not happen again. I am so angry right now my head is about to explode. To add further insult all the walking to find the boys and get them home again has set off the arthritis in my hips. I hurt like bloody blue blazes.

I don't have time to fix the fence today. Tomorrow I will haul my decrepit old body out and put up wire across the gap they created.

not quite the same situation but my wife and I once lived next door to someone with dogs, we also have dogs. there was an existing fence on the common line between our properties. Since we have dogs and children we did not rely on the old fence line that both the neighbors and we had. instead we put up a second fence. that way no matter what the neighbors did on their side of the property line we knew our dogs and children were safe and sound on our own property at all times.

maybe you can do that, put in your own fencing on your own property, not on the shared property line. they are well with in their rights to have taken down that other fencing, but they cannot remove the fencing that is placed a foot inside your property line as long as you have the sign clearly marked " No trespassing"

I am not going to put up 1700+ of fencing because these people are irresponsible. The wire and posts that are already there were put in place by my husband and me when we bought the property. I don't know fencing laws where you are, but in this area they have NO legal right to remove the wire and endanger my animals. Also, putting up a fence inside the property line eventually gives them legal right to that land if they want to claim it.

I guess I should add some background info to explain why I am so angry.

I've had ongoing issues with these people since they moved in. They are totally irresponsible with their animals resulting in problems for me.

After I spent a day putting in a garden their chickens came over and dug everything up.

They have a pony that used to spend more time at my place than theirs. I would show them how the little bugger was getting through the fence and offer suggestions what to do. They didn't do anything about it. It took me getting very firm with them and texting them every time he came over before they kept him home.

They used to have two ponies, both of whom would come visit. They also would escape their pasture and get in the road. One night I got a call from another neighbor who thought the ponies were mine they were here so much. He told me the ponies were in the road. I told him they weren't mine and directed him to the neighbors. He called to tell me no one answered the door. I texted the neighbors to tell them the ponies were in the road. They texted me back and asked if I would go catch the ponies. I was in bed sick as a dog, told them that and said I could not get the ponies. Next day one of them was in MY pasture. The other was dead because it got hit by a truck. They were surprised when I told them that the driver of the truck could sue them for damages to the truck. They did not understand they can't let livestock wander in the road.

In January they accidently set their pasture on fire. The fire jumped to my property. I spent the afternoon wetting my barn down to keep it from catching on fire. At some point while all this was going on they pulled down some fence. I did not know about them pulling the wire down until one of my horses came up ripped to shreds by the loose wire.

Finding the boys next door today was the straw that broke the camel's back. Thank all that's good neither of them was hurt!

In spite of two long vents I like these folks. They are nice people. They are just irresponsible. They start projects and never finish them. I suspect that's what happened with the fence. They tore down wire planning some project they never finished. That does not give them the right to tear down wire endangering my animals.

Can you have someone put a stronger fence up, just your side of the existing fence? Pretty much against it? That way they cannot legally (as far as I know) do anything with the new fence cause it'll be on your land and if they touch it, you could legally go after them I believe

I spent the better part of a week repairing the fence after talking to the neighbor and realizing they were not going to do jack about the fence. The "boys" are home and safe.
