hello,
Can anyone advise how i find can a sincere attorney that is versed in medical malpractice and PTSD (resulting from the malpractice)? What is involved and what kind documentation and other resources will i require? It seems like all i see are ads for ambulance chasers that are only interested in taking cases that they can easily win. I am located in Virginia and have not yet discussed this with any lawyers. thanks in advance, arwar |

IDK, I think you need to do a search online and "interview" a few lawyers. Yes, often lawyers want "easy cases" and may even "take on too many cases" because they are all about the "money they can possibly earn".
You will need as much proof as possible, including records from a psychiatrist saying your PTSD is caused by this medical malpractice. And you will also need "permanent" injury due to this medical malpractice. You will need to talk to a few different attorneys, some may just blow you off as you mentioned. the problem that i am having (particularly since i live in VA - which is also abbr for Veterans Administration) is that all the attorneys advertising as PTSD capable, are all wanting to argue cases before the VA dealing with military issues (mostly IRAQ, etc). i guess that the easiest way is to get some other lawyer to recommend one that is qualified (as opposed to law school roommate). i don't know, it's very frustrating.

It is not possible for me to recommend an attorney because I live in NY state and you live in Virginia. You must have an attorney who is registered to practice in your state. You MUST find an attorney who specializes in medical malpractice and have a diagnosis from another MD or two who can document that your PTSD resulted from malpractice by another MD. Often, doctors do NOT want to get involved in such cases. So, you may need an expert witness, usually someone who is either an MD who teaches or who is retired, to back you up.
Do you know any lawyers at all near you? If so, ask them for referrals. If not, ask your friends who they know. Otherwise, start doing research online. I spoke with an attorney regarding my C-PTSD case and was advised that I did not have a legal case because it would be hard to prove. You might find that your best option is to get treatment and forget the case. I KNOW THAT IS TERRIBLY DISAPPOINTING. Someone with PTSD wants revenge. I know I think that revenge against those who harmed me will result in a cure. Perhaps you do too. Another option would be to file a complaint with the state institution that issues medical credentials. File a complaint and attempt to have his medical license revoked. If you use the services of an HMO, alert them of your experience with this MD and ask that they remove him from their list of approved practitioners. Also, ask your HMO if you might get a second opinion. That way, there would at least be medical evidence that the HMO should remove the offending MD from their list of practitioners. Finally, if the offending MD was referred to you by your primary care physician, let the PCP know of your experience and strongly recommend that they should not longer refer patients there.
