Hi everyone
I was on here a while ago talking about my employer giving me a hard time because I have chronic migraines.

I eventually got an interview for another position and started that job in October. I am normally a healthy person but I have been having flu symptoms on and off. My new boss made some comment that I was "expensive" my first week.

Basically, my doctor ran some tests and made me stay home my third week. The boss called and asked my test results, I told him I tested positive for ANA, and he called me back the next day and let me go.

Thankfully my health seems to be ok now. My doc said that since everything else was normal, I probably don't have lupus or anything else. But I lost my job for the first time ever, had to apply for unemployment, defer my loans, etc.

Hmmmm. I'm pretty sure your boss violated HIPPA law by asking for your test results...assuming you are in the U.S. He also can't fire you because of illness, although you were probably still in your probationary period. If you feel scrappy, you could file a complaint or get an attorney. I would do it just because I like a good fight. I hope you stay well.

i agree re hippa act. he had no right to ask this question!!!! as long as something is medical you have the right to PRIVACY. that's a federal law. sorry this happened to you.

HIPPA applies to health care providers, not to anyone outside of the system. If your boss had asked your Doc what was wrong with you and the doc then told him...that would have been a HIPPA violation on the doc's part.

Unfortunately in the USA especially if there is no union....an employer can let you go for any reason at any time. Now if your employer fired you because of being too old, disabled, etc etc that would have been a big nono.

I'm sorry this happened to you, the old boss is a jerk.
