I am a Dental Assistant and I know HIPAA laws are the BIGGEST no no to break.. So that being said my son is in legal trouble who I am (I hate this word) the victim in the case. In the initial court hearing it was brought up by his juvenile counselor IN A FULL COURTROOM that I am bipolar!!! Mind you this was in front of other juveniles in this case and their parents. I NEVER once signed anything giving him permission to speak of this let alone gave him verbal permission!
I am literally in a battle to protect my son and they are about to send him to his father WHO I CAN PROVE IS AN ALCOHOLIC, PREVIOUS AND MY SUSPICION IS STILL A DRUG USER, DOMESTIC VIOLENCE HAPPENS FREQUENTLY AND THE GUY NEVER EVER HOLDS A RESIDENCE MORE THAN A FEW MONTHS!!!!
I called children services this morning and his court is Thursday how much louder can I scream to protect my son?!?! I'm about to go to the media on this crap!

I don't know, mmd. our juvenile court room is private, only one family at a time. my son has been charged twice now for assaulting me, and vandalism of the house. but i'm taking him to these hearings, and we're like a team even still. so i have not had to be pitted against him.

why did they bring up you have bp? are you trying to get back custody?

If my ex and i ever had a fight about the kids, I'm sure he'd bring up that I'm bp.

It's true that HIPAA protects you but really only at the doctor's office. A law firm can get the information if it "has to do with the case." And then use it. If they are trying to prove that you are "unfit" to take custody away, they would definately do that.

It's a reason why I don't want my ex knowing that I am actually diagnosed with bipolar. Even though he already has full custody of my son, I could easily see him using it against me later if for some reason he stopped letting me have visitation and I had to fight for my rights. But, who knows, I guess lawyers can dig it up.

I was the one open with the juvenile worker due to the fact that my son was just diagnosed and I was trying to explain that I think he is self medicating. He stole my car his friend wrecked it. BIG DEAL honestly WHO CARES the fact that he is now on probation, not following the guidelines and NOT BEING PROTECTED from his father now is what is PISSING me off!!! Like just now I e-mail the juvenile worker and am told he fell LAST WEEK and got stitches WTF nobody thought to notify his mother?!?!? I am SICK TO DEATH that they aren't even LOOKING at his fathers background, WON'T do a UA and when I am sitting here begging for help for him they are stipulating that I allow him to go to his fathers then he comes home with laughter on how his dad is funny when he is drunk and likes to fight and choke him out and doesn't even notice him taking cigarettes or drinking beer!!!! Not to mention his lazy welfare lost all her kids because of my ex freaking calling my son felon boy!!!
He is not a bad kid, he really isn't. He's making bad choices and he does SOOOO WELL with everything treatment, school etc UNTIL he goes to his fathers... GRR I could scream!!! I called children services this morning I am so pissed that this is even happening ESPECIALLY when his juvenile officer AGREES that his fathers doesn't sound healthy but stipulates that I am to allow him to go ARRRGGGGG!!!

My guess is that it was legal because it wasn't your own health professional who said it, it was your son's and his issues, treatment, etc. were fair game. It would have been different if it were your therapist.

That doesn't make it right though. Just legal.

my son just told me his probation officer said she doesn't mind if he smokes pot and he should get a marijuana card though, omg! i live in the nuttiest area, i swear! i agree meth is the bigger problem or other hard drugs, but the juvenile p.o. condoning his pot habit??? anyway...

so what is the visitation agreement with the dad - how often and for how long does he go to the dad's?

I have full custody always have... He is in shelter thinking if he refuses to come home eventually they will allow him to live with his father....

aww that really sucks... glad my son hasn't thought of that one. but he has crashed one of my cars, totalled. and repeatedly stolen my cars... i sleep on my keys, and my cash, and my meds - you know the drill.

are you guys doing therapy together? it has helped us somewhat - but then the therapist told cps something i asked her not to, she said she had to because of liability of their practice, arrrrrrghhhh... i suspect maybe she never told cps, because this was at least 4 weeks ago and they have not "stopped by", like they do.

Yeppers I've taken the classes, gotten him into the school he wanted, family therapy along with therapy on our own done it all.... I have a safe, my meds scare me he knows that one of my seroquil pills would more than likely kill him or REALLY REALLY eff a person up. Now my keys, purse everything go in there.

The whole therapist and cps thing~ Don't get me started!!! A therapist asks if ur on drugs at a PARENTING class and cps isn;t knocking my doors down??!! UM what? One time my son mentioned his grandma spanking him with a belt (which is another reason she;s outta our lives) and blamo cps
