Update 12/12/12

Talked with the atty today. He said that there are a few ways he could spin the case, but there is no concrete way out, no major ****ups by the police that could get me off the hook.

He said I have to go through with the fingerprinting and pre-hearing drug and alcohol assessment the county mandates. When I asked him how I should handle it if I go it alone, his response was, "That's like asking a surgeon to explain to you how to operate on yourself. Some things you just shouldn't do alone."

I'm no dummy. I know that was code for " That's a great question, but I'm not about to give you that kind of advice before you agree to pay me."
My response was, "I know. That's why I called you."

He said he would be emailing me a "fee agreement" and we could go from there. This guy's been so very helpful so far and if not anything else, has helped put my mind at ease, so I'm gonna stick with him. Gotta have an atty for the hearing anyway, and I make too much money to qualify for a public defender.

Made the appt for the drug and alcohol assessments and have to go get fingerprinted the week of Jan. 1-7.

Slept hard last night and woke up feeling very refreshed and ready to take on this mess.

Not to my surprise, the atty has not emailed me. By the way he sounded on the phone, and the rhetoric on his website, I don't really think he wants to take my case. Its not one that he can work his magic on or beat completely because of some handling technicality. He'd simply have to try to bargain and beg for me to get some kind of reduced penalty. The .163 BAC is just too damning. And all the theories I had of possible police errors, he informed me were all standard procedure.

so he doesn't want to take your case because he knows he can't WIN?
he can only bargin? is your case too trivial for him?

Those are my thoughts exactly, but he never actually said that. He did say he'd be sending me a "fee agreement" This was 1:30pm yesterday and have had no communication since.

I'm searching for more local people that will have worked with the local state police and magistrate before. I think I would have a better bet of getting liniency that way, since there are no major strings that can be pulled, even by a hot-shot big city lawyer.
