I am so happy to see this. I sincerely hope it makes it to the Supreme Court and is upheld. I'm in an inter-racial marriage which is still technically illegal in my state. I think that banning gay marriage is along the same stupid lines. I hope that the Obama administration doesn't fight this ruling, especially considering he once claimed he would help overturn the ban. ![]()

It's my understanding that interracial marriage has been legal in all states since the Supreme Court ruled that state law barring interracial marriage was unconstitutional. If memory serves, that was at least 40 years ago.
Anyway, I understand your thinking on gay marriage and I think that it is about time we had a solution too. Personally, my wife and I have talked about it and we don't think we should have been allowed to be married. Best we can determine is that historically, marriage began as a church union under which the church has authority while civil unions, by definition, fall under the authority of civil (not religious) authority. Therefore, since we were not joined by the authority of a religious organization but by civil authority, we should have a civil union not a marriage. In fact, we think that anyone (hetero or homosexual) who is married by a Justice of the Peace or in a city hall should be recognized as a civil union - and anyone who is married in a church should be recognized as having a marriage... Then we can talk about how they are legally the same. |

You are correct AkAngel, but it is still "on the books" here in Mississippi. The 1967 ruling overturned it, but we've never felt the need to change the laws. Many states did change their laws after the supreme court decision, but MS didn't.
To me (though I know many disagree) I don't care if it's called a marriage or a civil union. I was married by a justice of the peace, so I suppose I also have a civil union, which would be appropriate as we are both atheists. This was already posted about in the LGBTQ social group...(I'm basically with you on this... I also don't mind the name so long as all of the rights are there. The rights are important part...) I get the feeling this thread might turn political and bad though... just my premonition.

Yes it was a church decree to overturn the reading of the bans wich were the Celtic notices of unions sanctioned and blessed by the Clan Leader and the clanspeople. This was considered Pagan (because it was) and they wanted all reference to the Goddess & Gods and the old ways wiped out.
But happily there are more Banners being posted and handfastings performed now than in the last 1000 years...Shessssss baaaaaaaack ![]()

I think a lot of problems could be avoided if congress simply established a legal definition of marriage or civil unions. This can of course include homosexual folks.
Maybe something like ( and I know it is simplistic) "A life partnership between mutually consenting adult persons". ( I actually have no real problem with multiple partner situations as long as everyone invovled is aware and consents) This would allow gays to marry openly, while at the same time prevent people from using legalizing gay marriage as a means to promote preverted and damaging arrangments, like trying to marry a child or an animal. ( I know that is really sick, but there are some freaky people who actually try this stuff) |
