I am not sure where to put this so I will put it here if it needs to be moved it can be. Question 1. When an Estate is going to probate what happens after the administrator is picked? Do you have to sign papers to close the estate ? Question 2. If a lawyer is supposed to be working for you and does not do anything for a year and causes you to lose your property or almost lose your property can you have a lawsuit against the lawyer ?

Good questions....each state has their own way of handling probate from my understanding. I know that some way back family their estate whet to probate & my mom was who was to receive the small amount of money but because my mom had died (my dad died long before her) & I am an only child, so it came to me & I just had to get a notarized signature to claim it. Don't know if this helps answer your 1st question?

For 2nd question. Go to your state bar association. Google/Internet search it & usually will find a phone number you can call & ask about the situation you are experiencing.

This lawyer also after he was fired and gave back all the documents he could not find one. He shows up at the door 8:30 pm with a paper that does not belong to the case it was separation papers for another of his clients. When we met with him he threw pens at us. Also another question Does anyone take old newspapers and magazines to use for reference materials ?

Definitely talk to your state bar association about him & at least report what he has done. Those record information is kept for reference for people looking for a lawyer..review & reference information you might also save others from the aggrivations you are going through & bar has a group that reviews lawyers with questionable practice

yes you have to sign papers to close an estate. the longer it is in probate court the more money the lawyers make off of you dragging it out. that is the crooked system we live in and get use to it. i am going through it myself...tc

Like I said...lots depends on the state you are in. I ended up getting $ on an inheritance that went to my mother after she died & after I left my husband & had moved 2100 miles away. Think yes letter gave me a certain time to claim or the money went back into the probate account to be divided between those who were part of it....but that's been quite a few years ago so not exactly sure that's how it works. That was a Nebraska probate

The Administrator/Executor of the Estate gives everyone named in the Will a copy and has to make sure all heirs get their inheritance. They can also take a fee for acting as Administrator, but there's a cap on how much they can get.

The lawyer who was working for you- had you paid him anything as a retainer? Did you have a contract saying he was working for you or bills from him?
