Ok someone here told me that when you are getting help for depression and your spouse is trying to use stuff against you that they cannot take your kids from you. I've had several posts on here and I can't remember which one it was on. But anyways I have my "bad thoughts" and my husband tries to use it against me. He says he has copies of my journal. I'm just trying to find out where I can go on the internet and print it off so I will know exactly what to do. I hope I'm confusing anyone. I'm confusing myself.

...hmmm. Child custody laws vary from state to state. I know here in Virginia, it is the husband's responsibility to prove overwhelmingly that the mother is "unfit" or abusive. And even then, it is very rare that children are removed from the mother.

My best advice is to get a free consultation from an attorney that specializes in Family law.

Your spouse cannot "bad mouth" you and cause you to lose custody of the children. Generally, he will have to prove that you are a danger to them mentally or physically, or that you are unable to care for them properly AND that he is more capable of doing so. I know that I let my fear of losing my son keep me from going to a psychiatrist for several years, but once I finally went, I felt SO RELIEVED! My pdoc promises that while I have diagnosed problems, he would testify to my parenting ability if this should ever arise as a problem.

So, no, going to therapy cannot be used against you. Mistreatment is going to be the "big" deciding factor in keeping or losing children.

Also, I'm not sure it is legal to use your journals against you. Does he have any way to prove they are yours?

I am sorry you are going through this with your husband right now Angie. Hopefully you can get some good legal advice and have doctors who can help you through all of this. Wishing you well.

Things are going about the same. This new medicine makes me grogy though.
