Read in Martina's thread about the FMLA and wondered if anyone knows where it applies. I am not mentally stable currently. I am totally on edge, and barely coping with all that has happened. I am finding this forum helpful in that it allows me a safe place to express myself and i feel supported.

Tomorrow is Monday and I don't think I can face work. How should I deal with this? I had decided to take a couple of days off to find out how things would go legally, but I am worried about taking more time and I think honestly I need the rest of my life to recover from the last few days.

Does your company offer short term or long term disability? If they do you can take that time to figure things out. Usually fmla doesn't have to be a paid leave. But a lot of times short/long term disbility is partial pay. Do you have any sick time or vacation time you can iuse to figure some things out as well?

I'm a state worker & was previously in a higher classification and was downsized due to budget cuts/program cuts blah blah blah.. that is another story.. they have yet to determine from one classification to the one I am now what my time is. I am sure I have some time. Just don't know how much. I am sure that there is disability just don't know if I qualify given the circumstances.

FMLA is something you apply for at work through your HR deparment and involves paperwork and information from you doctor(s) to support your leave or intermittent leave for a serious health condition. It's important to get the paper work completed in the time allowed. It is job protection. It isn't income protection like short or long term disability so it isn't paid leave. It is confidential and between you and your HR department.

so I am wondering if the situation with my son qualifies as taking care of a family member who is seriously ill qualifies as I am out of the picture in terms of being able to know what his mental/physical status is due to the arrest. Oh and thank you so much for that link...wonderful resource

yes i believe it does re fmla and son. you are a direct family member of someone very ill who needs your care. i believe i am correct.
Overview

Covered employers must grant an eligible employee up to a total of 12 workweeks of unpaid leave during any 12-month period for one or more of the following reasons:
  • for the birth and care of the newborn child of the employee;
  • for placement with the employee of a son or daughter for adoption or foster care;
  • to care for an immediate family member (spouse, child, or parent) with a serious health condition
