So... I posted awhile back.. that his truck was broken into...

and now.. the results of the break in are starting to show up...

yepper.... this person is writing checks all over town... and the people that he wrote them to... are actually coming to my son's home... and demanding payment...

he right away.. closed the account.. and there was a police report..

But.. it is upsetting... to actually have people.. as in clerks... coming to his home....

I am not sure if clerks are responsible because they let it slip by.. and that is why... they are "visiting" him... or what..

it is a mess.....

legal counsel or representation..??? Atleast he closed the acct.

the bank you would think would be understanding of the situation.

Freewill,

This is not my area of expertise, but I wouldn't think that your son is liable to any of the people to whom any checks were written by the thief.

Oh no (((Freewill))) I am so sorry this is happening to you and your son. I can't imagine its legal that these people come to your sons house. Has he contacted the authorities about these random visits?

My son stopped by tonight... and I could cry... it has just turned into more of a nightmare....

The detectives are now involved...

But the stores... are accepting my son's checks... written by a woman

I mean... a man's name... clearly... no doubt there... and a women writing the checks..

the clerks.. are reporting what she looks like.. and they have her on survaance cameras now....

one of the major chain stores... says.. "it's your problem".... help me???? so anyone.. could pass a check???

and the account is closed....

Wow...that is horrible. I don't know what could be done. I am so sorry you two are going through this. I hope you can get it worked out.

Hey tell him my car was broken into, i can relate! Okay well i left the doors unlocked but you know, it was still illegal entry into my car. Its frustrating that there are people that low that go and do things like that. Thats what makes me mad.

i would start with the bank, he closed the account and the bank is handling things properly by returning the checks. they may be able to help with the stores or give a suggestion of who could. also the major chain stores all have somewhere you can go over their head, if the store manager won't help, find the corporate offices. your son can't be held liable for it and can probably do something about harassment if they don't back off him. just a thought.

edited to add, the stores are responsible for checking the ID of anyone who uses a check, therefore it is their own problem if they screwed up and let something get past them.

Hey Freewill,
Your son is the VICTIM!! The stores have no one to blame but themselves for accepting a check that is no good. These store clerks or whoever they are, have no right to visit your son at home or go anywhere near him. In fact, since they don't know your son except to "know" that someone wrote a bad check, they are quite stupid to be knocking on a stranger's door demanding anything!

Perhaps you could have a news station in your city that has an investigator or consumer investigator or advocate you could contact to get the word out. You would be doing a public service. In fact, if this chick's picture is now captured on surveillance, ask the local tv news to run it to ask for the community's help to locate her and bring her to justice, and to further protect the community.

The bank has insurance for just these types of situations. Make sure your son has given his bank a copy of the police report as they can't make a claim without it.

I'm sorry this had to happen. It really sucks. Sometimes I think some people's behavior just plain stinks. I'm sorry if that sounds harsh. I'm actually quite crabby and am not too keen on any human being right now.

When someone accepts a check - they are supposed to verify the identity of the person who writes the check - it is their responsibility in order to protect themselves.
The store should not have accepted the check.
The store did not carefully verify the identity of the person writing the check.
What does your son's bank say?

The person who stole his checks and who is writing on them (forging his signature) is breaking the law and this is the person who is responsible. Not your son. Forging a signature is against the law.

It's like when I accepted a check from a person who then told me - "oh there's no money in the account" - I am stuck with the check that is not cashable, unless I can convince that person to pay me cash, or unless I go to the police/court in order to force the person to pay.
I accepted the check. It is my problem now.
