Well, here's the scoop:

I fired my previous pdoc because he put me into manic episode that lasted for 4 months. I sought a second opinion, only problem is, my new pdoc (due to office politics) cannot handle my sick leave. I made an appt with my family doc, and HE extended my fired pdoc's medical leave to allow me time to adjust to the new meds and get (mentally) healthy to go back to work....he extended it to April 20th, long enough for my 6 week check-up with new doc and to go back to him so he can assess whether i can go back FT or with restrictions.

Called the practice manager this AM, and she said she wasn't sure if they would accept my fam doc's extension, they have never had this happen before. She was going to have one of our Union reps call me back to discuss it further.

Union rep calls back and says that since the original doc who put me on med leave didn't extend it, they aren't accepting it, and I'm expected to report to work March 17th.

I have practically memorized my Union contract, and can't find ANYTHING in there that says they can do this to me. I'm facing losing my job on top of dealing with trying to adjust to my new meds.

Can they do this to me???????

This sounds like monkey muffins to me. Do you have a lawyer? If not, can you afford some kind of legal counselling? I might could help. My ex's aunt is a paralegal and maybe I could have her take a glance at the contract if you want to e-mail me a copy of it. I'm not sure what good it would do, but I'll try to help if I can. Let me know and I'll PM you my e-mail addy. I sure hope this can be worked out.

A lot of what "they" can or can't do depends on whether you live in an ironically named "right to work" state of not. Right to work states have little protection for unions, therefore weak unions, and unions wind up sucking down whatever the bosses order.

I have an attorney, and called them. She said that they can't deny my sick leave extension, doesn't matter who extended it or not...

I'll just have to wait until tomorrow when the Union Rep calls me to let me know the final decision. Thx for the offer tho Ry.

Dol,

It is against the law for an employer to fire an employee who has a Dr's permisson for a medical leave of absence. If they try to do that, you can file suit and own the darn company.

Even if the original doctor that started the medical leave isn't the one who extended it?

I switched pdoc's cuz I wasn't getting the treatment I deserved (to stay mentally healthy) and the new one CAN'T do my sick leave b/c of the way the organization that funds the program is set up (it's grant funded). I went to my family doc after seeing new pdoc, and he is in the loop as well (so to speak) and HE is the one insisting I wait until my 6 week follow-up because I have had such a drastic med change. My family doc is the one who did the extension, and he isn't clearing me until I see him after my 6 wk f/u so he can determine if I can go back with or without restrictions.

All of this is such a mess, and I'm on pins and needles waiting for them to make up their minds. Heck, my attorney called me this morning already to see if they had gotten back with me yet.

I love my job, and the practice manager told me yesterday that my patients call the main office to ask about me all the time. They would be fools to deny my extension because of the great rapport I have built with my patients; it would only make them lose current and potentially new patients.

Just have to hurry up and wait I guess.

Well, here's the scoop:

Owner of the company just called me and told me that I still have a job, they are accepting the extension.

So, I explained the pdoc switch and why my family doc is in involved. He just said "OK, thanks, all I needed know."

I asked him where would I be going when I come back on 4/21. He told me I will have to go back to my home store with THEM (lol) but things are going to be very different.

He told me that Sandy's (Ofc Mgr) playing favorites days are over. Faith is being demoted because her college schedule conflicts too much with her work schedule, and I am getting the tech position....7 miles from home instead of 23.

He also he's going to be doing spot checks 1-2 a WEEK!! just to see how things are going, because he doesn't want to move me from my home store until the new store is built - of which I will be office manager.

He told me that he's been thinking a lot about how much of an asset I am to the company, and I deserve that position. He said he will have the new description written specifically for the new store, and to best accommodate me.

(Just a l'il aside - I've known about the new store for months - we all have)
