I have a question... when going to court i requested my therapist records.. they failed to give them and wont give them to me.. Yet my Psych Doctor handed over his (but his arent what the Judge wants, She wants the Therapist reports as the place i go makes me see a therapist and psych doctor) they are my records.. without them i will not get the much needed help i need.
They said even with a subpoena (the judge requested these records) they will just hide behind the Hipaa act. so what can i do why can they keep taking my money and falsely make me believe they are trying to help me when in fact they are not... without my mental records the Judge cannot rule honestly and fairly.
this has sent me to an all time low.. no one wants to help, i feel its a big scam they take money to help me I dont know what to do.. why can't they give me MY records. Even my Lawyer doesnt seem to care

Does anyone have anything they can tell me to do so i can get these much needed records.. They are my records i should be able to access them!

Unfortunately, psychotherapy notes fall under the exception to HIPPA access. What reason did your therapist give you for not releasing your notes to either you or the courts?

Maybe start there and emphasize the implications of you not having the notes.

If there is still refusal, request your mental health records. They are different in that it provides a record of sessions, diagnoses, symptoms, treatments, and prognosis. Unfortunately it may be similar to what your pdoc gave the courts.

Maybe ask them to write a summary or report of impressions, diagnosis, things your working on. But if they are refusing to provide notes, they may refuse that as well.

they gave no reason other than they dont have to under the Hipaa act.
i feel completely let down. I have lost trust in them, they arent there to help me they are only there to fill their pockets... getting any info out of them is like pulling teeth. I dont feel i should have to beg for my records, and my lawyer is disgusted. Even the Judge on my case is appalled at their behaviour.

and they were told of the implications, it has spun my depression out of control all this added stress... and all they can say is "stay Positive" and take more money out of my account.
