Does anyone know if the 'statute of limitations' applies to rape and hostage situations? It's been 12 years and I feel guilt b/c I think he probably has repeated this crime. I should've pressed charges then, but, I could barely function for years. I've been on disability ever since, (2 failed suicide attempts b/c of) so maybe that could be a loophole. Any help will be greatly appreciated.

I think that would vary by state, victim age, and sentencing guidelines. IIRC there is no statute of limitations for crimes punishable by death or life in prison. I'm guessing you mean you wish you had reported it... I don't think a victim needs to file charges in most crimes. I believe a state attorney or district attorney or a grand jury would be responsible for bringing charges for rape.

Um...I am not a lawyer, so I advise you to contact a women's centre or a women's health clinic that specializes in rapes. Each state can have a different statue of limitations, but rape and forceable confinement situations are considered felonies. This may suggest a longer period of time in order to prosecute the perpetuator. Again, this was from a quick search of the internet ATM. I hope you will find answers to what you seek. How old are you? It is different law when the crime was committed when you were younger than eighteen years old.

The only state I KNOW - is Virginia. There is NO statute of limitation on sexual assault for the Commonwealth of Virginia.

But...I just found a document that lists all the states...it was compiled in 2003, though so some of these laws may have changed.

I am 51 now, I was 39 and 40 then. This was someone that I trusted (my fiance @ the time). It was so traumatizing that I could barely function, all I could do was go through the motions and do as told. The incidents took place in 2 different states, so I can see complications from that, however, both states have records of the 'attempts' and what led to them. I am now back in my home state which is different than the 2 states mentioned earlier.

Thank you for this. The list is incomplete, only one of the two states is listed and the limitation is 10 yrs.
