When I had my wreck in 2003, my car was towed to a place. Well the owner called about a week later and said he needed it off his lot so my grandmother and me went to go pay the money and get the car. When we got there the owners wife said she had already sold it to a used car guy down the road. Which as fine by me it took care of the lot fees and I did'nt have to worry about towing it home. I went to the car dealer to get stuff out of the car. It was some clothes my Cds and my Valium the doctor gave me and the title to the car so I could have it transfered to the car dealer. He would'nt let me nowhere near my car and made me leave his lot. Well I forogt about all of that until today. I went to go put a truck my grandmother gave me in my name and found out that the IRS audited me for my wrecked car. Apparently the car still has an active title so I owe back taxes from 04 till now. Well my question is is'nt this like stealing? I never gave my permission to sell the car. And when they did I never signed anything giving the title to them. I did'nt even know they had sold it till it was too late. Now I have to pay all these back taxes before I can even get a vehicle.

what a mess! sounds like you were done wrong by someone in all of this. If you qualify, try to get free legal counsel. Good luck and I feel for you!

I think you have 90 days from the time it was towed. and for the sale to be legal, the title HAS to be transferred from your name.

she had no right to sell the car. I am sure insurance had not even settled with you on it. so yes that would be illegal but since it has been so long not sure what you can do about it now. call an attorney though for sure!

Hey bebob. Yeah ins. had'nt settled and I had been in the hospital with my youngest son from the day after my wreck. I did'nt even know that it mattered if the vehicle was totaled. I hope I can get this cleared up. To answer Tim's question on the title it is listed as active if that means anything. Thanks all you for your replies. I just don't want to waste my time with getting the county attorny to look at it if there's no use.

I would say that the original sale wasn't legal to begin with, however once you agreed to the sale, there should have been some paperwork. You didn't have to sign anything? Here the only way they can sell the vehicle is if it's considered abandoned. You can't even junk a vehicle here without signing the title over to the junkyard.
