I'm in manic mode so please forgive if this doesn't sound quite right.....
I have a claim in with Disability. When asked what doctors I have seen for pain and depression, I have a list... I have one doctor that once called me lazy because I was getting sciatica all the time. LAZY! I walked and was on my feet from 6:30 AM till 7:00 at night.... that's lazy? I also had another doctor that saw me for a pain issue. After being referred to another doctor for orthopedic issues I wrote him a letter describing my pain and mental issues. I never got a call, no referral, no nothing......QUACK! Then there is my previous employer. I was the ONLY one running the department and had to be there from bell to bell. I once had an accident and had my ankle swollen for 2 weeks with possible ligament trauma and I still could not take off. I couldn't go to physical therapy, take time to see a doctor, etc.... Do I have grounds to sue these a**h***s?! |

I wouldn't bother with suing. It costs money, takes time, and isn't about personality but whether what they actually did, caused damage. It just sounds like they didn't do anything for you, not that they did it "wrong".
I'd look for a doctor who understands you and your problems and work with him/her. But doctors don't know everything; if you don't think a doctor has an answer that suits you, go find one that does. One has to work together with one's doctor to get a good doctor/patient "fit". Maybe the second doctor didn't know anything about mental illness and didn't think he could help you. But calling you names or not responding to letters aren't suing offenses, they just mean those doctors aren't ones you want to see. Suing can work against one too, if one does it a lot; one could get a name for suing and doctors wouldn't want to work with one (and they don't have to). I concentrate on my own issues rather than any doctor's. If a doctor doesn't suit me, I find one whose ideas and methods more closely agree with mine. I had a major medical scare several years ago and a lot of mistakes were made but most of them are only noticeable in hindsight, once what was wrong with me was fully known. Of 4+ doctors I had to work closely with over six months, I almost sued one but did not because it wouldn't have helped me any. My therapist recommended courses of action I also did not take, to help others seeing that doctor so the doctor could "correct" her practices and not endanger others as she had me but that would have been a lot of work for me to do for others and I wanted to concentrate on getting better at that time (I almost died a couple times). __________________ "Never give a sword to a man who can't dance." ~Confucius |

No. No grounds imo.
You can barely win a case if a doctor does something negligent TO you, much less prevent care. Besides, it's your word against theirs. Plus, you'll then have a record of suing a doctor, and no doctor will want to take you as a new patient. So the only one losing in this case would be you. Most doctors are quite ignorant of or unwilling to treat pain patients. You are your own best advocate at times. You can write each a letter for you file, being very nice and innocent acting, and inquire as to what you can do better since (for instance, he considered you lazy when you work ...such hours etc.) __________________ |

2 doctors actually killed me about 4 years apart and I had great grounds for suing but I didnt for 2 reasons.
1 I was too afraid to, 2 we are all human. OK 3 reasons, no amount of money could have bought or paid for the journey I went on both times. I'm a little more of a realist now and realise I should have sued because of all the issues these mistakes would cause me later in life. One of the doctors was drunk I smelled the wine on his breath, he cut me so badly that my heart to my abdomen looks like a venitian curtain with 6 scars which were sutures put in place to actually hold my gut together.... I think to win a suit you have to demonstrate both negligence and harm. If the doc said something that pissed you off, such as that you are lazy, that is not enough. The doc who didn't respond to the letter could always say he didn't receive a letter. If he didn't know you, he could not provide advice, as you were not his patient. I think docs usually receive their information firsthand from patients during appointments.
The case with the employer and the swollen ankle sounds like it might merit a complaint to your HR department. If you can show permanent damage to the ankle, there might be a case. But as Perna has said, suing is expensive. And a hassle! I have TMJ disorder due to periodontal surgery several years ago. It really irks me this dentist gave me this really painful disorder--he should have stuck to fixing the gums. I have been to a couple of other dentists to try to get some relief and they all say it was caused by this surgery. But what is my recourse? All I really want back is a functional jaw that does not hurt, not money. I would not sue for this because I think it would be mentally unhealthy for me. Plus, it takes a lot to win these cases.
