I have applied for disability and am trying to decide on a lawyer or advocate. Who has better statistics or rates of having claims approved? I was diagnosed as bipolar, major depressive disorder and ptsd in 2005. Please help!

If your initial claim is denied you can appeal. So really no point hiring one now, you already submitted the information, if denied then I would say hire a lawyer, they only get paid if your awarded Disability and they take a percentage of your back pay.

Call around and talk to a few offices. The firm I decided on was the fact that disability is about all they handle, my lawyer use to work for SSDI.

It's been denied. Someone is filing the appeal for me. There is a lawyer who does 30% ss disability, 35% personal injury and 35% workers comp. She passed the bar in 2008. The non attorney advocate says she is a retired technical expert for the ssa with over 32 yrs experience. Thanks for any advice you can give me.

Does the advocate has a good track record of helping people win there cases? Do you have to pay her anything? If you have to take this all the way to a court hearing will she be able to go with you? will her input matter or be taking into consideration?

My lawyer was with me at my hearing.

The advocate said about 60% success rate. I'm thinking it seems wiser to go with a lawyer. The advocate is filing the appeal so I feel guilty not going with her plus all of her experience. The lawyer said she would be at the hearing or they sometimes do a remote hearing from the office! Which is awesome because of social anxiety. But she will charge extra for travel and med records retrieval. The advocate didn't really tell me much about herself except the charge for winning the appeal. Thanks so much for replying. I'm sorry it took me so long to respond.

Go with the attorney I was told that that most cases get denied first. This is how they weed out the people who really are not sick.

When I saw the disability doctor (SSA doctor) he told me he was going to approve me. Much to my surprise I got denied. That was late January. I called my work they were helping me get disability and they said they were not surprised. They got me in touch with a lawyer who mailed me forms to fill out which I did and mailed back. They called me on Presidents' Day I will never forget that because I would have thought they had that day off. We went over everything on the phone. So that was mid feb I received my back pay mid march. I received my back pay before I received my letter saying that I had been approved.

If you get denied then approved the most they can take out for attorney fees was $5,000 now I think it's up to $6000 they usually take what is owed to the attorney first.

If you keep getting denied and have to go before a judge then they get a percentage of what your back pay is. Some people that I know have been fighting for 3 years to get approved and others have been approved right away

I would go with a lawyer that just does disability claims. They will not take your case unless they think you can win.

I used a disability lawyer for my appeal. he took me because he said I would probably get it. he expected I would have to have a hearing but I didn't. They automatically take his pay out of your backpay when youre awarded ONLY if youre approved...so don't worry about how youll pay if you win.

Christina is correct. A lawyer will take 33%, if your case wins. The time after a lawyer is about a year or two. Make sure you ask the lawyer about working or school how it will affect your case. My ex could not do either while waiting. He moved in with his mom and it took two years. Good luck
