i found out this morning that i lost $115k because the neighbor forged my name on the warranty deed that he wrote to himself and his wife. as you will recall, we lost the first buyer. it took two years to get it out of his hands and then six months to get it out of federal court when he filed bankruptcy. for the uninformed, he borrowed $123k on my property and no one did a title search. the government's atty is primarily the person who cost me the most. she was a frigging witch from hell. she said that she knew that the property was mine but she thought some of his creditors might still have a claim to it!!!!!!!!!!!!!!!!!!!!!!!!!!!! so, while that went on, the only way we could get a buyer, to wait, was to reduce the selling price. who would want a piece of property that the government was holding?

we sued everyone that touched the paper and a f****** judge let them settle together for one lump sum of $11k. so, i'm pretty much f****** for my future. the $11k will get me through some school and the move to Austin and a little left over for savings. my lawyer waived ALL of his legal fees. and that would have been $24k.

how's that for a swift kick, first thing in the morning?

Pat..I am so very sorry about this. How terrible. Such greed and brass. Such injustice. Similar things happened to me, twice.

Last time...I lost everything.

he has lost all of his property and had quite a few things that he had stolen from me. they were auctioned off. it is one of the most difficult things that i've ever had to deal with. the betrayal and the theft and greed.

anyone can get your legal description of your property and forge a warranty deed to it. BUT when they go to borrow money on it, a title search should be done. no title search was done on the deed that he wrote himself. i worked so hard on that place to make it beautiful. i did all of the landscaping myself, laid the wood floors, painted the rooms, etc. it makes me physically sick to think about it.

the first buyers were giving me so much for the house that that was my profit. this place is on the Rio Grande River, apple orchard, etc. so when they got tired of waiting, they withdrew their offer. then the legal stuff started costing more and more and more. the fees that i had to pay just to file stuff cost thousands. the government took thousands in fees while we were trying to get it out of his bankruptcy plea. then in order to get a buyer, we had to lower the price considerably. then that frigging judge stepped in and cut our throats. it can happen. it does happen. and now the government wants to be able to condemn our places, if what is going in will be a place that will be economically productive for the area. like a big hotel or an industrial park.

Ok seriously, call Dateline, or 20/20 or freakin Oprah! Get this story out there, this is insane! We've all seen those shows, the "watch for this, this could happen to you" stories. Even if it can't help you, this can't go on! Wow.....I admire your strenght in this Fay.
