my last roomate skipped out on me leaving me with his 370.00 bill.

I finally managed to contact him today and asked him where the rent money was. He tells me most of it went to dry cleaning (I doubt this) Anyways, I explained to him calmly that we had a mutual agreement when he moved in that he would pay me on a month to month lease basis.

Well he took off with a weeks notice.

He says he doesnt owe it to me because of the CAT HAIR in my apartment he had to get everything dry cleaned.

To top this all of this is one of the people that were supposed to be my friends, we got along great until he just took off..

Now, if SA doesnt pull through or EI falls through, I will potentially lose my apartment because of this.

He KNEW right before I left that Iwas having a bad time and was in and out of the hospital. HE KNEW THIS and ASSURED me that he would still pay the rent. HE TOOK ME TO A PARTY the night before he left to show his good faith.

And then he took off. Hes blocked EVERYONE of our mutual friends (he grew up with my boyfriend)

Is there anything I can do? Im screwed arent I.

Sigh.

Hey that sucks what your roomate did, sorry to hearit. Sounds like you got taken over big!!

I would keep trying to get the money for a time, but dont expect it to be easy!! GOOD LUCK

Unless you had something in writing there is no way to prove he was living there and helping w/ the rent.
Also, it may turn out poorly in your favor if your landlord didn't know you took him in and had him paying rent.
So, just be careful and check your lease first.

Dear Rainbow...... I am bleeding for YOU - for I feel your anguish.

But from the legal stand point (court) - YOU have no legal rights unless you had something in witting to prove that he entered into a binding agreement with you to pay the rent.... SORRY!!! - but in court it is all about the CONTRACT - - - never mere words (yours against his).

sigh.

yeah, I think this thread was half rant half desperate plea for a fix to the problem.

Ive calmed down a bit now and i know to be honest its probably not even worth my time.

BUT

Im tempted to get small claims papers and fill them out and send them just to scare the crap out of him, since you dont have to pay the fee until you actually go :P

oh, it would be so satisfying.

You know what makes it all the worse is hes bipolar too, and he knew i was going on disability for at least 12 weeks. We even talked about how hard it was going to be for me hence him reassuring me.

Taken-advantage.

I totally got taken for a ride, but lesson learned I guess

i'm so sorry. if landlord was aware, i would take him to small claim's court. it's a small fee, but worth it. did y'all do receipts or anything in the past? do you have ANY proof? i'm sure he knew you had a cat when he moved and and accepted your generosity I need Legal Advice

i wish you so well. does he work, etc?

yes kimmy, he does work. At a pet shop very close by at that!

A PET SHOP

That has cats.

Where he gets pooped on and thrown up on and bit and everything else all day lol.

Which, now that i think about it makes it all the more preposterous.

Hmmmm- you know, kimmy. the landlord would still have cheques ( or would be able to get cheques back from the bank) that he wrote the entire time.

They even state rent on the check itself under the memo.

Hmmm I hadnt thought of both of those things.

And its only 50.00 to go small claims.

Hmmm.

A verbal contract also is considered binding.

Rainbowzz, you can file a small claim suit against him. I was in the same situation a few yrs ago.

Sounds like you have a good small claims suit on your hands that will net you $300 which is $300 more than nothing! Good thinking! I would be at the court Monday morning getting the form. If you have problems filling it out and have a scanner, scan it in and PM me with image and I'll be glad to help.

I think you are right.

And honestly I should do it if for nothing other than because he shouldnt get away with it.
