Prescription medicines from March 2015
From March 2015 it will be illegal in England and Wales to drive with certain illegal drugs in the blood, even if you’re not unfit to drive. It will also be illegal to drive with certain levels of certain legal drugs if you’re unfit to drive. Talk to your doctor about whether you should drive if you’ve been prescribed any of the following drugs: clonazepam diazepam flunitrazepam lorazepam methadone morphine or opiate and opioid-based drugs oxazepam temazepam You can drive after taking these drugs if: you have been prescribed them and advised how to take them by a healthcare professional they aren’t causing you to be unfit to drive Source: https://www.gov.uk/drug-driving-law |

Wow! That's a scary law. Say someone is prescribed a benzo and tolerates it fine. If they get in a car accident, it's very possible that their blood levels are going to be checked and they could end up with a drug-driving conviction, even if the accident wasn't their fault or if it wasn't caused by the effect of the drugs on them.
Do you interpret the law that way? |

They should be fine if:
you have been prescribed them and advised how to take them by a healthcare professional they aren’t causing you to be unfit to drive |

But what if you have an accident and a blood test is done? How could you prove that you felt just fine and that the accident wasn't caused by the med?

One would hope all users of these medications would seek and follow guidance from a qualified professional and keep suitable documentation. Otherwise you might up shite creek and no paddle.
However the same goes any condition, migraine, lack of sleep, influenza - if you drive while unfit you lay yourself open to prosecution or even prison if you cause injury or death and you may face civil action and your insurance is invalidated. However don't worry most people render themselves unfit to drive by using their phone while driving, and life goes on. Have you ever tried tweeting while overtaking a lorry and trailer on a narrow twisting road - it is not as easy as it looks. |
