So my boss who knows I suffer from depression and some of the medicine thinks I qualify for FMLA. She says it would excuse my abscence when I'm feeling oversleepy. The Meds cause excessive tiredness. I'm not sure how I feel about this. Anyone have any experience with FMLA?

I'm on fmla for my depression, yes it excuses your absence but you get 12 weeks, paid or unpaid. I used my entire 12 weeks last year and my boss approved my absence after that for a couple of months till it was time to file new fmla papers. My pdoc completed my medical certification for me and right now my paperwork gives me 4 days a month for fmla. If I end up hospitalized or my situation changes to where I can't work I'll have to fill out another set of paperwork

How's it work for depression. One of the items states condition that would prevent me from working.

I'm currently taking my fmla intermittently and my pdoc indicated that I might miss work 1-4 times a month because of my depression.

I used FMLA while I was in PHP. I was also told recently that if I need to take a day off because I'm feeling a little "off" I can use FMLA on my time sheet so it doesn't look like I'm taking excessive days off just because.

You would need proof from your doctor. And you would have to have the FMLA paperwork completed through your employer with that proof from your doctor.

With the medicine causing you to be over sleepy, do you think it would be a good idea to get an accommodation under the Americans with Disabilty Act (e.g starting at 9:30 vs 8) or would taking it intermittently (you get up to 12 weeks in a calendar year/ total of 480 hours) would be better?

You would need to get a dr to complete a medical certification stating that your illness prevents you from participating in major life activities. I'd talk your dr about it but sometimes Drs are reluctant to endorse FMLA

Remember, FMLA is unpaid. I used it with my PTO so I could still get a paycheck.

I just used my first FMLA day last night! My Pdoc gave me 1-4 days/ month also. If I go over that I have to have a note from him. Up to 12 weeks of course.
I was so thankful for it, I absolutely needed it! I still feel super weird in the head this morning, if I would've went in like that, chances are good something inappropriate would have been said or done. I finally feel job security so I say, GO for it!
