Well, it's hardly a relationship question, but I'll give it a shot, because it's really bothering me.
I have this landlady. I give her money. She takes it. We have this sort of special relationship, that way. Coming to the main issue.... She wants me to move out before the end of the month. My rent cycle is the 1st to the end of the month. I wasn't able to move in here before the 2nd of the month, because the tenant who left before me didn't vacate in time. But I paid on the first. She specifically insisted I had to pay on the first but move in on the second. She wants me to leave "before" the 31st of the month. Why before? I have no idea. Why the 31st? I assume someone else is moving in. This is against the law right, to cut a day off my lease? What can I do? (P.S. I really want the option to stay 2 days longer because I am literally moving out of this country, and this cuts down the time to pack/ get a reasonable flight out of here!!!!) |

Do you think you could offer her two extra days of pro-rated rent based on a thirty day month (June), and point out that she won't be losing any rent money, that you're in a pinch? Maybe you could offer to pay her two days pro-rated rent of the new tenant's rent amount? Just to be really nice? But if she already accepted your rent for this month, you are legally entitled to be in your space until 11:59 PM on the 31st. You have a contract, and consideration has been paid by you with the understanding that you get the place for a month in exchange.

If you carefully read your lease I'm sure there is a clause stating that it is her right to ask you to leave the property whenever she pleases. What she CAN'T do is take your money for time you haven't lived there. If you move out early, you need to be refunded the pro-rated amount of rent. Really, your rent should have been pro-rated for moving in a day late.
Go through your lease VERY CAREFULLY. There has to be a clause about early or late move-in/out. If not, then you are the one with the loophole and the advantage. |

No one can state with any certainty what the rental agreement says without reading it. While most rental agreement have fairly standard provisions, just because my contract says one thing does not mean another contract does too. Also, the landlord/tenant laws vary in each state.
lastyearisblank, read your agreement. If need be and you now reside in the U.S., call the state bar association and ask to be referred to a landlord/tenant attorney for a free consultation. Look in the yellow pages under attorneys to find the number. Having practiced law for over twenty years, my gut tells me your landlord is trying to railroad you. What about a security deposit? If you made one, you should be getting the deposit back with some interest too. Despite my misgivings, it is the contract that tells you what your rights are. An attorney might be helpful to give you a clearer understanding of what your rights are. Good luck. |

Yeah.
We talked again today. This woman is pure evil. She is totally lying. Not to mention the 31st is a Sunday, a day when nobody in this country does business. All of this, is to prevent me from leaving on a Monday morning, like my agreement with her is supposed to allow. So that my landlady can drive here on a weekend and get my keys (12 sweet, sweet hours early!), and I have to leave with my luggages and bags and stuff, and stand on the street looking for a taxi on a Sunday afternoon?????? What in the hell. P.S. Our conversation was really scary!!!! I'm just plain scared now so I guess I'm leaving. |

Well, if you have no room to negotiate with the Evilyn, at least you have some time to try to figure something out for those two days you need, right? Get back on the horse. If you're not going to joust, then take a tour around and try to pin down your options. It should do a lot to assuage your anxiety over this predicament :-)
