My ex is still on the mortgage.... For now
Ive had a feeling over the last few months he's been coming in when I've not been here. I've asked him and he's denied it. I'm going away soon and my neighbor need a key to feed my cats. I asked ex for his and he said he's lost it in his mums house that's why he's never been coming in when I asked. Should I just change the locks anyway? |

Yes change the locks. My ex had ex wife who claimed not having a key but then she came in when no one was home. We then changed the locks finally

Hi Divine, thanks for reply I WANT to but as he's still on the mortgage (doesn't actually contribute towards it anymore) I know it's a grey area |

My ex totally comes into my place unannounced when I'm not there and it really angers me!
Once he bought realtors around when I was at work and my room was a mess. I had my bras sitting on my chest of drawers that I hadn't packed away. There are other times that I know of too. What an invasion of privacy. |

Well, just work with what he told you about it not being him.
He knows you think someone has been getting into the house, so just change the locks. After you have done that, tell him you changed them because it was somebody other than him.

What can he do about you changing the locks?

As he still owns the property with myself he is entitled to a set of keys and access as its still his house.
It's not his HOME tho and he hasn't lived here for nearly 2 years now. Just don't wanna get caught out somehow by changing them without his consent or not telling him etc |

Ask your lawyer what's right thing to do. I am pretty sure if he doesn't reside there showing up when you not home isn't ok.

His being on the mortgage changes nothing. You are the sole resident.

I'm still on the loan even though the loan mod was just in his name. As part of the divorce & loan mod I did a quit claim on the property. If I ever get back there to get my things, I will be required to have him there when I take my things out ( if that ever happens?)....so no, after the divorce, the judge determined who owned the house even if his name is still on the loan, he no longer owns the house....at least that's my understanding of how it works from talking with my lawyer.

Just change them if you want to. If he complains and your lawyer says you have to give him a key, you'll give him one of the new keys. You can tell him what Michaela said if he even asks.
