I have a gigantic problem. I wake up intoxicated from my landlord's marijuana and cigar smoke. It leaks into my apartment from his since is my neighbor and that's the way air travels in the building. All the smoke seems to collect in my tiny studio apartment and make me sick and involuntarily high. I cannot afford to move and I am disabled and incapable of moving without lots of help that I don't have. Last time I spoke to my landlord about this, he asked me to move, but after looking for 12 hours a day for 2 months I gave up. I found nowhere in my price range. I am on the section 8 and disabled housing lists but they are years and years long. Can anyone think of any solution to this problem? A better way to talk to my landlord? Any other solution?

I very much enjoy NOT being addicted to drugs, and have been sleeping in strange places away from home in order to stay unaddicted, but without going into additional stories this is becoming a big problem.... I am only in my 30's and dream of a better future.

...Landlord says he cannot smoke outside because of the kids in our area and in other parts of the house. Smoke goes in my direction and apparently not the kids direction much.

Well I just want to point out that you can't get high off second hand smoke.

That is not factual. Back in the 70's I went to a Doobie Brothers concert in the coliseum at WVU and as soon as the lights dimmed people started lighting their joints and a huge cloud of smoke was visible rising from the floor. That was my first experience with weed. It was so bad that I still had a sore throat the day after the concert.

Have you considered speaking to an attorney or legal aid about what your rights as a tenant are in this situation?

I can't imagine a single neighbor putting out as much smoke as what you experienced at the doobie brothers concert o.o If this is true it had to have been a lot of smoke.

Yes, I have been to functions where there was a hell of a lot of smoke and never experienced anything other than the stink permeating my clothes. I would say if you are getting high that it is more than likely to be the placebo effect. I really don't think there is any reason to worry about getting addicted to anything.

There are some good choices above about contacting police. I have another thought though. I would suggest talking to the property manager or owner about this.

I agree too you have rights.

My other thought pertains to any rights this other fellow might have, mainly is this medicinal weed? He then has the right to light up. But, with that said, there are other ways people are often encouraged to get their dose and that is by consuming edibles and the usage of other products like oils.

Again, talking to the property manager/owner could help with this.

I had a similar problem with a neighbor who smoked cigarettes. I had to buy an air purifier in order to live in the apartment.

If he's smoking weed, then you have a sure bet he doesn't want you to report it to the authorities. If he kicked you out for reporting, you'd have a nice lawsuit on your hands.

What I would do, is tell him to get an air purifier for both of your places or you will report him.

With section 8 isn't there someone you can call? There should be someone that can help you get into another place.

And like the others I don't think you are getting high from the pot but you might really be sensitive to the smell of it and the smell of the cigarettes I know I am

Even if you are not technically getting what most other folk would deem "high" from this continual invasion of secondhand smoke, Joe, you have a highly (lol! ) valid complaint!

Some folk, who are very sensitive to tobacco or weed smoke -- including some previous smokers of same, in fact -- have true difficulties coping w/it.

Section 8 frowns on situations such as the one you're experiencing, in my longish experience. Unless MJ is legal where you live, which is unlikely but not impossible -- then he could get in deep sewage with the Housing Authority ! Not that I think you should threaten him with that, but it's a card to keep in one's back pocket if all else fails.

Please have a good intensive read of your lease terms. It probably contains provisions for "Lawful Use" and possibly terms involving "The peaceful enjoyment of my home" or similar wording. It is landlord's responsibility to assure that -- and he isn't, imo. In fact, he's interfering.

An Air Purifier with a good strong filter sounds a great and reasonable idea in the interim between now and going into a different flat when/if available. Very best of luck; sorry your home is being infringed upon by this inconsiderate jerk.

Chyia, in full sympathy (pot smoke tends to trigger headaches for me, and fiancé is on medical MJ-- whee. lol)
