Got called into work early. And was fired. I asked if it was due to my mental issues. The big boss siad Yes. They did'nt feel comfortable having me there. My work was always good. I got a lot of product put out nightly. After I got back from my 1 week in patient. Some of the guys at work treated me very differant. I think they were just looking to get rid of me after that. Told me I left s door open last thursday night. I never recied any written warnings at all. And was always told my work was good. Do I have any options?

I would consult an attorney. It sounds discriminatory.

I believe that the Americans with Disabilities Act provides some protection from this sort of thing. You might start with NAMI (National Alliance for the Mentally Ill) or consult an attorney that deals with discrimination issues. Good luck!

I agree, you can either call a lawyer, or the Human Rights Board in your area.

I doubt they did anything illegal; if it were, you can bet they wouldn't have told you why you were fired, would have said something else. http://employeeissues.com/fired_job.htm

Businesses act illegally all the time, out of either ignorance or arrogance. Even big corporations like WalMart have been successfully sued for discriminatory practices. It is at least worth looking into.

if your situation isn't discriminatory i don't know what is. i'd definitely contact NAMI or an attorney. at least you will obtain an answer regarding your being let go.

see a lawyer ASAP! This happened to me - i'm uk - and i got paid a small fortune not to take them to court

they also brought up that I destroyed my work pants during my outbreaks.....

Run do not walk to the nearest labour attorney. You definitely have a case, if nothing else you'll get a better package. You may want your job back, that may not happen, and even if it did, I personally would not want to work there given those kinds of attitudes. I don't know you're exactl laws but here in Ontario, you'd have a strong case for discrimintion.

I've been fired before just because they didn't like me. They'll lie and make up any reason to get rid of you and it's hard to fight it

Kinda feel quilty, Calling a Lawyer..Work did treat me ok till they Fired Me..also I don't like making waves....But hell can they just fire people they want anytime?

Well yes, unless you're in a unionized environment, an employer can pretty much fire anyone, for anything, at any time, unless there are laws specifically prohibiting it, such as discrimination laws, which are hard to enforce. It really comes down to how much they have to pay to make you go away quietly. Most provinces / states have minimum notice / severence provisions unless they're claiming they fired you for cause, which is really hard to prove.

I'll use my case as an example. I got fired at the end of June. No cause. The reason I was given was simply that the managing director wanted me gone. The managing director hated the fact that I worked flex time, to accomodate addictions treatment. I couldn't claim discrimination though, since nobody knew why I worked flex time, it was just something I'd negotiated when I started. Anyway they offered me the minimum spelt out in my contract, 4 weeks pay in lieu of notice (ON's statuatory min. is 2 weeks/ per year) and two month's severence, one month for each year I'd worked there. 3 months isn't a lot of time to find a job. I however knew the details of every severance package that had been paid out, as I administered them, so I went back with a counter demand, basically saying they had no cause for firing me, that they admitted it wasn't performance related and what they were offering wasn't consistent with what they'd given othe employees.

In the end I got the 4 week's pay in lieu of notice, 5 months severence, 6 months of benefit continuation, 1/2 my annual bonus and $2k for outplacement services of my choosing. And I'd only been with the company for 2 years.

Employers count on employees not knowing their rights and not standing up for themselves. You've got a discrimination complaint, make them pay to get rid of you.

Learn and move on.
Destroying company property apparently has made them feel that you were not a good fit for the company. They do not know that this violent behavior will not escalate and they are doing what they need to do to protect their employees.
Learn from this what is good work behavior and what is not. Take that with you to your next job.

I don't think I would want to return to the job if I was in your position, so I would not persue it legally. I would just want to move on and keep learning and building my own life.

and so you should! you have every right to call a lawyer even if they tell you there's nothing they can do.

Did your work give you anything in writing?

You are not totally responsible for what happens in an outbreak, that is why you take medication and get treatment and hospitalisation.

You have done everything in your power (which is your responsibility) to ensure you are as ok as possible at all times. You have proof on here of the times you were begging for help in stopping things and making it go away.

In effect you have hundreds of witnesses here who can attest to your attempts to be ok. Take this further and don't allow the stigma of mental illness to ruin your life. These people need educating and they need anti-redneck collars to show them that YOU are the one who suffers and is afraid, not them.

I was fired 2 years ago from a management position with the explanation of "they needed to make a change". Come to find out the owner just needed a position for his brother-in-law.
