We are having a problem with my brothers ex girlfriends mother. My brothers ex passed in the storm and he got her cremated. Her body was under water in the morgue for over three months and that seemed the most senseable thing to do.
Now my brother has met someone else who he will be marrying and they moved with his son to Illinois. My nephew wanted the remains of his mother and took them with him. We were told by a lawyer that my nephew has the first right to keep his mothers remains. Now the problem is the mother of his ex has been harassing me for over a year, many times when i was in my fema trailer. And yesterday came to the house demanding the remains. I had bayou in my arms who was barking his head off, which i think scared her from forcing her way in. She threatened she would be back and knock whoever answers the door out of the way to get the remains. I informed her they are not here and to leave us alone. She demanded they were, that she had proof they were here. I did not tell her that my brother and nephew moved to Illinois because i didnt think it was any of her business. She still assumes that he is living in Metairie. She cares nothing of her grandson and has stated that many times in the past. With the threat she made yesterday, I called my brother and told him what had happened. He said for us to get a restraining order against her. Today i went to the clerk of courts office and got the paper work to fill out and get notarized to start the process. My question is, if any one here has gone through the process of getting a restraining order and if they think it is worth getting? Or wait till she tries again and take care of it another way, which i care not to mention here. When she came over yesterday she was high on something. And was every other time she came harrassing us. She is a pill head and is always under the influence of many drugs. Her boyfriend sits in the truck screaming at her inticing her to go further with her endeavor to make threats and harrass. I don't know what exactly to do here and would like some suggestions from ya'll. Any opinion will be something for me to think about and probably help me to make a definite decision. I would advise getting the restraining order and if she shows up again please call the police. Keep yourself safe. ![]()

Most definitely try to get the restraining order. Different states and counties have different laws regarding restraining orders. It's best to have it on record that this woman has been harrassing you so that the next time it happens, you have the copy of the restraining order, it's on file with the courthouse so when the police show up they can arrest her for tresspassing and ignoring the restraining order.
I do NOT suggest taking matters into your own hands as then you run the risk of being arrested yourself. Now what in the world good would that do???? Personally, I would not answer the door and just pick up the phone and call the police for an unwanted visitor. Even if you don't have a restraining order, if she is trespassing, she can be removed. I had a restraining order against my stalker. I got help from a person with the local police department--I think she was a social worker. She basically did everything for me but testify and had an emergency order in hand that same day.

Here in redneckville Florida, restraining orders (or sometimes called injunctions) are issued by the clerk of court. Not sure how it works there. At first they are temporary til you see a judge, then they can become permanent. Just write down everything in the form they give you and file it. That's crazy for sure and no reason for you to be dealing with that.

(((((chalmette))))) they are right, get the piece of paper even here in Aus it works like StarPonysMama says there are people at the courts to help you do it right the police will arrive much more quickly if you have a restraining order, also they will arrest her, something our police can't be relied upon to do if the intruder is know to you, unless you have the order if you're lucky, having the papers served on her will put her off best wishes ![]() ![]()

(((((Chal))))) I'm not sure of the process, but do get the order. You don't want someone like that bothering you all the time. Hopefully it'll be enough to let her know that bothering you means jail time.

I filled out the forms to the best of my knowledge and went back to the clerk of court this morning. They would not accept the forms because i had no address and her last name has been changed. She married the boyfriend and we do not know his last name. So doing a restraining order is now not an option.
Clerk of Court told us to call the police and file a report with them so that they have a record of it. That i've already done in the past, but the police said filing another one more up to date is worth doing. They told us when she shows back up to automatically call the police and they will be here within minutes. I just wanted to let you all know what has happened since you've all helped so much. Thank you and if we can find out more information on her we will go through with the restraining order. chalmette

the only other thing that I could think of... was asking a lawyer to type up a letter stating that you do not have the remains... that might.. get thru to her that you don't... coming from a lawyer |

OH, Chalmette, I am so sorry to hear you are having to deal with this woman!
I did have experience with a stalker, calling the police numerous times. On the night of the "incident" with this character, I had called the police who went to talk to him, angering him, while he was down the street at his parents' house. It culminated with his breaking thru my patio door with a gun he had stolen from the parents' house. He tried to shoot me several times. I am relataing this because this person, who stalked me, was also an addict and it sounds like this woman who is harrassing you has similar addictions. Please be very careful. The police weren't very effective until this incident i related. Patty |

sounds rough... I don't like confrontations at all. I like dealing with police even less. I have no idea how I'd handle it... good luck in all you do, wish you the best.
