Some of you may know that my son was fired after filing for workman's compensation. He works with dogs and was attacked by one and then they fired him.

He has undisclosed depression. This is really taking a toll on him. I don't know how to help him at all.

Maybe I'm looking for ideas for helping him. Maybe I'm just devastated for him and wanted a hug. I don't know

Sometimes it sucks being a mom. Honestly.

I would seek legal counsel. I believe firing him for filing workers comp claim is illegal?

Thank you Emily. We are looking for a lawyer, but (while it's obvious that that's what they fired him for) it's difficult to prove, legally.

I always try to look at everyone's side in a situation...even if it would be to my detriment, I tell it like I see it. I simply cannot see this as anything other than retaliation for him costing them money (when he couldn't work because the doctor hadn't given him clearance to do so).

He had been speaking to human resources for two weeks when they sent a letter saying he had been let go as of two days after the attack. He had to have stitches on his face and now has a scar. He couldn't move his fingers because the bites were deep on his arm. This was a big dog.

Work didn't talk to him, the dog owner didn't talk to him...nothing.

He only wants his job back. That's all.

But it is not difficult to force a settlement. (from the employer's insurance) not the employer. At least have a free consultation. Unless I am missing a fact this seems like a strong case which could get some money for you even if you don't want to litigate.

Sorry this is rotten too the core but it's how they operate. Your son's civil rights have been violated. I assume he has ongoing medical treatment for this and workers comp is covering all medical and lost wages. I don't think he can collect unemployment also though but now that he has been terminated then he should still file unemployment. I don't know what State you live in but there is a good chance that the unemployment by termination would be investigated by them.

I'm not from US so can't comment on legal system, just wanted to say this all sounds very bad treatment of him and while it sucks seeing your son go through this it is great he has a supportive caring family and I know from your posts you will be there for him.

Thank you very much for everyone's kind comments.

It DOES suck. I know business is business. But jeez...

When someone with depression can find a job that brings a smile, it was too wonderful. Then to have that taken away...he's worse off now...

We're having trouble finding a lawyer.

Now my son had to drop his insurance because he can't afford it.

The bills keep coming to our address.

It's like....so unfair. If you knew this kid. One of the kindest, most trusting people I know....to have this happen makes me sick.

I am so sorry this has happened to your son. I hope you find a lawyer soon. The employer should be paying for all those bills through worker's compensation.

It's seems strange that no lawyer would want to take on that case. It seems fairly cut and dry.

1) If you were a judge, and some attorney tried to dismiss a witness's credulity based on a medical file unrelated to the event (dog attack), what would you do?

2) If you were a judge, what would you require to establish what had happened to the "victim"?

3) If you were a judge, what would you do to a corporate mentality which kept hourly employees wages below poverty line based on the rationale it would be difficult or unlikely those employees could retain an attorney?

Violators, mocking the law all the way! Yeah, well....what if we don't choose to be manipulated into a violent revolution? Maybe not all attorneys lack ethics.

Who is the real judge, Mom? Be a warrior of justice with the Prince of Peace for your child.

We can't find a lawyer. I know it's all about the money, and we really don't want anything he's not entitled to. Maybe that's the problem.

We also can't find the owner of the dog, who I think should be notified.

I can't explain how much this affects me because it affects my son.



I'm so lost on what to think and what to. I guess I'm stupid as I had faith and now I don't.
