On Sunday, I was "coached"(for those who don't work at Wal Mart or its child companies, a coaching is a write up.) I was coached because apparently a member struggled with topsoil and it fell on the floor. I did not see this happen (I'm partially blind and can only see what's directly in front of me). After my lunch, the two COS's on duty came to get me to take me upstairs. I went and they presented me with my write up. They looked very intimidating in making me sign this.

"What happens if I don't sign this?" I asked.
"You're terminated." The COS said.

I signed it because I felt bullied into doing it, when I didn't even see this event take place.

Fast forward to today. At 11:30, the front end manager came to get me. I was going to talk to her about what happened on Sunday. We get to the manager's office and the assistant manager and the head of security are sitting in there. They have me take a seat.

She beat around the bush for fifteen minutes about it. Finally she said that I had "Committed gross-misconduct after threatening an associate."

I have three problems with this:

a.) I'm not a threatening person, all of the associates I worked with will tell you this.

b.) I'm a pacifist. I keep to myself, and kept my lips sealed tighter than superglue. I would never wish any harm to any associate.

c.) They couldn't tell me what was said. They seemed to be happy that they fired me. Whoever initiated this must have been thinking of someone else.

I have been a victim of workplace bullying too. I believe that you can file a complaint with the EEOC (U.S. Equal Employment Opportunity Commission - see www.eeoc.gov).

As a person with a disability, I presume that you had notified your employer of your vision limiations?
Thanks for this!

Yes I did. They just shook it off.

I hope you will consider any of unhappyguy's suggestions here. I believe him to be quite knowledgable in these matters, sadly from experience.

Excuse me please while I take a personal moment ...
*... mumbling ...*
"working at WalMart" ... "WalMart employee
treatment" ... "employee rights"

Okay, back now ... Sorry ...
Anyway, please take care. I hope you can find a real job.

Roadie

I have been harassed terribly, bullied and physical assaulted on the job. Based on what you have written, please do contact the EEOC.Gov and file a complaint right away.

Did your former employer give you copies of the documents you signed? Were you aware of what was happening or were you in shock during the coaching and at the termination?

In addition, I would do some research and send an email to a few employment lawyers and explain what happened in the email, and then follow-up in a few days by telephone.

It does not cost anything to speak with a lawyer to discuss a potential case.

Wishing you the best of luck. Please continue posting and let us know how you are doing

If that link doesn't work just google Roadie's second moment... WalMart employee
treatment

Sounds like you ran into some employees on the Walmart fast track to upper management. Good luck!

Worked 6 years at a Mental Health Peer Support organization. All was well until new supervisor hired. Got suspended for unsubstantiated allegation; complained about the lack of evidence for my offense and got suspended again. Went on a sick leave and was immediately fired. Am fighting back using Human Rights violation legal defense. Haven't got a clue what outcome will be, but a Mental Health agency shouldn't be able to use a person's mental illness against them, especially when staff are supposed to be people with "lived experience of mental illness and/or addiction"!
Unbelievable!! Good luck to everybody affected by lousy economy, wherever you live.

I been harassed and bullied at work myself. I am retired now, and happy not to be working. Bullying is epidemic in todays work place, not just at Wal-Mart. Bullying is a sign of immaturity and a need to be in Control. "Control" is the biggie. Immaturity causes it.

Do stand up to bullying, say goodbye to the horrible job at Wal-Mart. Be careful who you work for.

Look up discrimination laws for your state. See if there is anyone who can advocate/mediate for you. They may have lawyers who can work pro bono as well.
Bullying is not illegal unfortunately. Most states are fire at will, which means they can fire you for anything. But they are not allowed to do it due to protected class, such as your disability. Most lawyers will try not not help you actually because it's hard to fight discrimination. Were there anytimes that anything was said about your disability and were reasonable accomodations made? Explain the thing about the spill and how you did not see it, and how management would not take into account your visual impairment before writing you up. That sounds like discrimination to me.

I too was a victim of workplace bullying and was fired because of it. I went to the labor board when i didnt recieve my final check for 5 days after i was fired. I won that case. Now I am filing a claim for unemployment. I know they will dispute it. How dI I explain I was a victim of workplace bullying and not misconduct my bully convinced others I was doing? I finally was fired when a bogus letter was received from a customer complaining I did something wrong and the bully who had done something wrong was thanked and apologized to. Letter was written by the bully acting like a customer and no one questioned it.

This happened to me too. After being sexually harassed and bullied for years I was fired for "threatening" a receptionist at work. Of course, the whole threat thing never happened. My work ended up paying me severance and calling it a layoff when they realized I might sue to keep my reputation. You might want to consider filing a complaint under the Americans with disabilities act. If you couldn't see it, I don't see how that was your fault.

I used to work for walmart at the corporate office. I'm so sorry this bs happened. In my experience the upper management had all the control. Open door policies were a joke and then they had the good 'ol boys club. I hope you find a new and different emoloyer that respects you.
