I have a question since I have been reading the posts on here (OMG i didnt even know this was here) and 2 yrs ago I applied and my mom is still getting calls as she was the one who filled out the 10 page thing on me...but I have never been approved or denied...how do I see what is going on and give them new dr information?? Maybe new dr will help sway them faster...??????

God, I hope this post makes more sense than the others I seen that I wrote...i am so upset by that! ~ melanie

you have never heard anything? geesh do you have an attorney? if not get one! they only have like 60 or 90 days to give some kind of response.

you can also call their 800 number in the meantime and find out where you stand.

Moggles just contacted them and they say in their system it is still pending!!! OK, now the task of a lawyer...just pick one from phone book?? or is there a site on weeb that goes by state and provides reputable ones...i am sorry i am asking n nt researching I cannot think really far enough along and am getting so friggin frustrated!!! any help would be awesome...i am in california and so i just need ummmm, god i dunno....melanie

oh and does me getting married to moggles have a bad impact on me?

as for the last question it depends on wether you are attempting to get ssdi for which you need 20 work credits in the last ten years or ssi which doesnt have that requirement but is income based. So for SSI it would depend on household income and for SSDI it would not.

If you look in the phone book you might see listings for lawyers that used to work for social security and are now on their own. They know the system best.

10 years!!! whoo hoo cause I last pulled top wages in 2000 and 2001!! I just am tired...and it is messed up and anyway...thank you thank you thank you

I sent an email to a lawyer and am waiting to hear from them. I hope they can help

make sure the lawyer specializes in SSDI, dont get a lawyer who just does it on the side, the rules and nuances of social security are very complex, thats why i picked one who had worked for them.

None of the ones listed in phone book give that information...I picked who will call me later to discuss things. I can ask then. Any other questions I should ask to make sure things will be copecetic???

how many cases has he /she handled is a good question
if they arent specialized in social security you can ask do they know who is

or you can contact one of the national firms like allsup

they wont take your case unless they think that they can win because that is how they get paid....winning

You might try contacting the local Bar Association, too. They often have a referal list of attorneys who specialize in Disability cases. Your state probably has a cap on the amount you'll need to pay any attorney ... cases are handled on a contingency basis and attorney's can make anywhere from 25-30% of the total to date in the worst case, or a cap of $750 in the best I've heard about. You live in a "progressive" state, so it won't be too bad.

Be sure you everything ready when you finally do see an attorney. If you've kept a journal that will be very helpful ... if not, start now and think of how your disability has affected your ability to work for the past 10 years. Try to show how you progressively got worse until you finally left the workplace. A doctor telling you it would be best not to work will be invaluable! Or at least a doctor who would put huge restrictions on the type of work you can do, how long a day, etc. The attorney will most likely suggest someone for you to see if your GP can't help. There's also a possibility that Social Security will send you to THEIR doctor.

Social Security wants you to dwell on the <u>DIS</u>ability part, not how able you still are, so be prepared for a little depression, OK? I got sucker punched when I filed! I'd been living with chronic pain from 1987 until I filed in 2004 and spending a good 2 weeks on paperwork while I viewed my glass as half empty got to me. Just know it's a possibility and not going to last.

Having said all that, and please don't get upset at this, are you sure you ARE disabled? There are retraining programs available and even plans where the government will send you to school so you can qualify for a different sort of job. If you're not totally disabled as I am, sometimes you can still work parttime and earn up to "X" dollars without it affecting your Disability income.

Am I sure?? no. I know I am hurting. ALOT. I know I am diabetic. I know dr. said fibro. I have peripheral neuropathy. I have endo. I have gastroparesis or IBS or something those to that. I have cluster/migraine headaches. I have depression, ptsd, anxiety/panic attacks. I cannot sit stand walk bend or sometimes get up with any modicum of normalcy. So, no I am not sure. I tried working a delivery job, but 4 hours of work made me cry n limp n hurt...I couldnt handle it n started missing days n quit. SSD is fickle here...will just have to see where I get taken!

Ok it appears I have to reapply and they don't have a record of anyone calling for status and last time I applied I was denied in 2004. So now I need to get going on a lawyer as they are sending out the paperwork and I can't even think. Moggles has had to balance checkbook after seeing my subtraction was so far off. My brain is mush. I just want to scream. My house is falling apart aroundme and I am barely keeping it maintained. I can't write anymore with pen and paper...i am quaking. To top it all off it is that time and I am soooooooooooooo emotional..I just want to crawl in hole and die but we all know that is too easy and it won't happen. ~ Melanie

hon did you get a letter of denial? I know you had said it had been 2 yrs and you had heard nothing at all. if you have to start over you will lose all that back pay. they only went back a yr on mine. find a good attorney for sure

Hmmm. Well perhaps things have changed. When I was denied, and the disability insurance company wanted to pawn me off on them years later, it was no matter what, once approved it was prorated back to the date of first denial.

There is no such thing as no matter what as far as SSDI is concerned. You could be judged disabled after the first turn down and not get a start date back to that first application. They pushed my date back 7 months and asked me at the hearing if that was acceptable which i accepted based on the bird in the hand theory. This was based on additional medical evidence of an additional illness,which came in after i was turned down the first time and before my hearing .

I am looking for an attorney and in the mean time I have them sending me paperwork to start over and see what everyone has to say, like my dr coming on board, attorney helping, etc etc. I am so tired..they said my last denial was 2004. I am not sure what is going on and I wont get anything, but oh well. I think I am just going through the motions at this point.

Keep trying. It is a very difficult road (and that's a shame!) but well worth it. Do it now, while you "can" because you may not be able to do even what you are accomplishing now, in the future. (((hugs)))
