He's alive. It's about fraud and breach of fiduciary duty. My husband took the case, but doesn't feel want to do the trial. I am a better trial attorney than he is. Not much either of us can do when the client suddenly decides to back down and tell a different story at a deposition. I tried taking a break, but the client just insisted on telling this new version of events.

A question for the lawyers:

Do you really ask witnesses if they know the penalty for perjury?

And what is a good answer? I would be tempted to say, "Google it."

My mom apparently had a very high heart rate and very low blood pressure when she got to the hospital.. They are running tests now to see what is causing it.

In many states, a conviction for perjury requires that:

1. the person testifying knows they are under oath
2. the information being testified about is material to the case
3. the person testifying knows that the information is material to the case
4. the person knows their testimony is false
5. AND the person knows the penalties for the false testimony.

Hence, the question, "Do you know the penalty for perjury?" If they say no, you tell them.

If they don't know, you tell them. A smart *** answer in a ballpark that is not yours is usually not a good plan

Have you used this line?
I suppose a facetious or hostile answer makes the witness look like a liar.

I'm feeling stressed, angry and belligerent.
I'm spoiling for a fight and I don't know why.

It would be easy to blame my rupture with T, but I'm not convinced that is the right answer.

Ike thanks... I hate using the phone and the worse thing that could happen is that she answers her phone.... I could probably call if I knew she was in session but she works part time so I'm not sure when she is working...

Hi everyone. I really need help in deciding whether the money I use for T is worth it this week or can I hold out for another fortnight and spend the money on other things? I'll get the money back on Friday from medicare, but it means eating canned food and having no cigarettes (the tough one)til Friday morning. I'm just totally incapable of making a decision about this.

Confession time, I locked my keys in the car Sat nite, had to call the locksmith Sun AM. I am $87 lighter and upset at my absent mindedness. Expensive weekend, but at least I didn't have to watch the Heels get crushed.
